The Minutes (copies of which had been circulated) of the meeting held on 28 April 2011 were approved as a correct record and signed by the Chair.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of Agenda Item 4 (Licensing Act 2003: Application for a Premises Licence at Stockport Pizza House, 14 St Petersgate, Stockport) as the appendix to the report contains information relating to an individual the disclosure of which would not be fair and would therefore be in breach of Data Protection principles.

 

Minutes:

RESOLVED – That in order to prevent the disclosure of information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of Data Protection principles, the public be excluded from the meeting during the consideration of the ‘not for publication’ appendix to Agenda Item 4 (Licensing Act 2003: Application for a Premises Licence at Stockport Pizza House, 14 St Petersgate, Stockport).

Licensing Act 2003: Application for a Premises Licence at Stockport Pizza House, 14 St Petersgate, Stockport pdf icon PDF 37 KB

To consider a report of the Service Director (Environment).

 

The report details an application from LA Pizza Grill to supply late night refreshment.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Stockport Pizza House.

A representative of the Service Director (Environment) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application for a new premises licence from LA Pizza Grill to supply late night refreshment at Stockport Pizza House, 14 St Petersgate, Stockport.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.

 

A representative of Greater Manchester Police attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  There were no further objections made by any responsible authorities.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder licensing objective in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

(i)           Crime and Disorder

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the considered that by granting the this premises licence, groups of individuals would be encouraged to remain on the street which would increase crime and disorder.  However, the Sub-Committee was of the view that there were a number of premises licensed for late night refreshment in the immediate vicinity of the application site, and that there was a lack of evidence to directly attribute most of the incidents which the police had presented to the Sub-Committee to the premises.

 

(ii)          Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)         Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the gathering of drunken people around late night refreshment licensed premises fuelled incidents of violence, noise nuisance and acts of criminal damage.  However, the Sub-Committee was of the view that there were a number of premises licensed for late night refreshment in the immediate vicinity of the application site, and that there was a lack of evidence to directly attribute most of the incidents which the police had presented to the Sub-Committee to the premises.

 

It was then

 

RESOLVED – (1) That the hours for the supply of late night refreshment for consumption off the premises be approved as follows:-

 

·         12.00 to 01.00 hours, Monday and Tuesday

·         12.00 to 02.00 hours, Wednesday, Thursday and Sunday

·         12.00 to 04.00 hours, Friday and Saturday

 

(2) That the stated, standard opening hours be noted as follows:-

 

·         12.00 to 01.00 hours, Monday and Tuesday

·         12.00 to 02.00 hours, Wednesday, Thursday and Sunday

·         12.00 to 04.00 hours, Friday and Saturday

 

(3) That staff be trained to immediately report any issues regarding crime and disorder to police and that staff be provided with access to a telephone for this purpose.

 

(4) That CCTV be installed and maintained at the premises, with recordings being retained for a period of 28 days, and that said recordings be made available to the police upon request.

 

(5) That the public shall have access to the front portion of the shop only which shall be separated from the kitchen by a high counter with all fittings securely fixed.

 

(6) That all spillages be cleared immediately to prevent slips and falls.

Licensing Act 2003: Application for a Variation of the Premises Licence at XXL Bar pdf icon PDF 38 KB

To consider a report of the Service Director (Environment).

 

The report details an application from Benjamin Bardsley for a variation of the premises licence at XXL Bar.

 

The Sub-Committee is recommended to consider the application for a variation of the premises licence at XXL Bar.

A representative of the Service Director (Environment) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Benjamin Bardsley for a variation of the premises licence at XXL Bar, 21 Fletcher Street, Stockport.

 

The representative of the Service Director (Environment) reported that the applicant wished to amend his application to exclude Part N of the application which referred to adult entertainment.

 

A representative of Greater Manchester Police reported that in the light of the withdrawal of that part of the application which referred to adult entertainment, the police had no further objection to the application.

 

It was then

 

RESOLVED – That approval be given to the amendment of the premises licence as follows:-

 

(i)         To remove from the licence the condition relating to the secondary door system.

(ii)        To amend the condition relating to the retention of CCTV footage from 31 days to 30 days.

(iii)       To amend the condition relating to the ‘incident report’ and ‘staff signing in book’ from ‘a duplicate’ to ‘a hard back’.

(iv)       To amend the condition relating to door staff such that door staff be required at the premises from 22.00 hours, Friday and Saturday and to remove the requirement to have door staff at the premises on Thursdays.

(v)        To remove from the licence the condition relating to holding meetings with residents.

Licensing Act 2003: Application for a Premises Licence at Dorchester News, Hazel Grove

To consider a report of the Service Director (Environment).

 

The report details an application from Mr Lalit Kapur for the supply of alcohol for consumption off the premises.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Dorchester News.

Minutes:

A representative of the Service Director (Environment) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application Mr Lalit Kapur for the supply of alcohol for consumption off the premises at Dorchester News, 12 Dorchester Parade, Hazel Grove.

 

The applicant and his representative attended the meeting and answered Councillors’ questions in relation to the application.  The applicant’s representative indicated that he wished to amend his application to reduce the hours for the supply of alcohol for consumption off the premises to 07.00 hours to 21.00 hours, Sunday to Thursday; and to 07.00 hours to 21.30 hours Friday and Saturday.

 

A representative of Greater Manchester Police attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  A representatives of Environmental Health & Trading Standards also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder licensing objective in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

(i)           Crime and Disorder

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there had been a number of reported incidents of criminal activity in the immediate vicinity of the premises.  The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective, it would be necessary to impose the following conditions:-

 

·         That CCTV be in operation during licensable hours and that images be retained for 28 days and made available to the police, the licensing authority and trading standards upon request.

·         That all members of staff and management be able to operate and provide downloads of CCTV footage.

·         That the premises seek the approval of the police on he position of CCTV cameras if there is any doubt as to the suitability of the placement of cameras.

·         That a personal licence holder be on site at all times when alcohol is available at the premises.

·         That no illicit alcohol be kept at or sold from the premises, and that receipts for all alcohol and cigarette purchases be kept and the premises and be made available to the police, the licensing authority and trading standards upon request.

·         That all target alcohol be kept behind the counter.

 

(ii)          Protection of Children

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the premises had been responsible for the sale of age restricted products to an underage trading standards volunteer. The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective, it would be necessary to impose the following conditions:-

 

·         That staff be trained in the prevention of underage sales, the prevention of the sale of alcohol to people who are already drunk and other matters under the Licensing Act 2003 and that signed, written records of this training be maintained.

·         That staff receive refresher training at least every three months and that signed, written records of this training be maintained.

·         That a refusals book be kept and used which will include a full description of the persons attempting the sale, what was attempted to be purchased and the reason for the refusal and that this be reviewed and signed off by management.

·         That only original photographic ID be accepted as proof of age.

·         That if it is suspected that alcohol may be passed to a person under the age of 18, then the sale must be refused.
