Licensing Act 2003: Application for a Premises Licence at Dorchester News, Hazel Grove

To consider a report of the Service Director (Environment).

 

The report details an application from Mr Lalit Kapur for the supply of alcohol for consumption off the premises.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Dorchester News.

Minutes:

A representative of the Service Director (Environment) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application Mr Lalit Kapur for the supply of alcohol for consumption off the premises at Dorchester News, 12 Dorchester Parade, Hazel Grove.

 

The applicant and his representative attended the meeting and answered Councillors’ questions in relation to the application.  The applicant’s representative indicated that he wished to amend his application to reduce the hours for the supply of alcohol for consumption off the premises to 07.00 hours to 21.00 hours, Sunday to Thursday; and to 07.00 hours to 21.30 hours Friday and Saturday.

 

A representative of Greater Manchester Police attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  A representatives of Environmental Health & Trading Standards also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder licensing objective in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

(i)           Crime and Disorder

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there had been a number of reported incidents of criminal activity in the immediate vicinity of the premises.  The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective, it would be necessary to impose the following conditions:-

 

·         That CCTV be in operation during licensable hours and that images be retained for 28 days and made available to the police, the licensing authority and trading standards upon request.

·         That all members of staff and management be able to operate and provide downloads of CCTV footage.

·         That the premises seek the approval of the police on he position of CCTV cameras if there is any doubt as to the suitability of the placement of cameras.

·         That a personal licence holder be on site at all times when alcohol is available at the premises.

·         That no illicit alcohol be kept at or sold from the premises, and that receipts for all alcohol and cigarette purchases be kept and the premises and be made available to the police, the licensing authority and trading standards upon request.

·         That all target alcohol be kept behind the counter.

 

(ii)          Protection of Children

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the premises had been responsible for the sale of age restricted products to an underage trading standards volunteer. The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective, it would be necessary to impose the following conditions:-

 

·         That staff be trained in the prevention of underage sales, the prevention of the sale of alcohol to people who are already drunk and other matters under the Licensing Act 2003 and that signed, written records of this training be maintained.

·         That staff receive refresher training at least every three months and that signed, written records of this training be maintained.

·         That a refusals book be kept and used which will include a full description of the persons attempting the sale, what was attempted to be purchased and the reason for the refusal and that this be reviewed and signed off by management.

·         That only original photographic ID be accepted as proof of age.

·         That if it is suspected that alcohol may be passed to a person under the age of 18, then the sale must be refused.

·         That if it is found that a person has passed alcohol to a person under the age of 18, then this person must not be sold alcohol in the future.

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)         Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that local residents were being disturbed by large gatherings of youths in the immediate vicinity of the premises which would be exacerbated by the availability of alcohol.  The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective, it would be necessary to impose the following conditions:-

 

·         That the premises agree to the random UV marking of alcohol containers at the premises.

·         That all posters and obstructions be removed from the front windows and doors.

·         That written authorisation be left when the Designated Premises Supervisor is absent authorising specific persons to sell alcohol for a specific time period.

·         That written records be kept of any incidents in the shop, including gatherings of youths and thefts.

·         That the premises report to the police gatherings of youths outside the premises.

 

It was then

 

RESOLVED - (1) That the hours for the supply of alcohol for consumption off the premises be approved as follows:-

 

·         07.00 hours to 21.00 hours, Sunday to Thursday

·         07.00 hours to 21.30 hours, Friday and Saturday

 

(2) That the stated, standard opening hours be noted as follows:-

 

·         07.00 to 22.00 hours, Sunday to Thursday

·         07.00 to 23.00 hours, Friday and Saturday

 

(4) That CCTV be in operation during licensable hours and that images be retained for 28 days and made available to the police, the licensing authority and trading standards upon request.
