The minutes (copies of which had been circulated) of the meetings held on 23 and 25 July 2018) were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 6-13 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Items 6-13 to prevent the disclosure of information relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicant and would breach their data protection principles.

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken urgent action under the constitution to suspend 20 hire car drivers’ licences.

 

RESOLVED – That the report be noted.

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of the conduct of a Stockport Licensed Private Hire Operator and vehicle proprietor.

 

The Committee is requested to determine whether or not the Private Hire Operator and vehicle proprietor remain fit and proper to hold a Private Hire Operator Licence.

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of an application for the grant of a Private Hire vehicle licence.  Licensing records indicate that this vehicle has previously been licensed by Stockport Council.

 

The Committee is requested to consider whether or not to grant the licence.

The report informs Members of the proposed licensed hire car vehicle driver’s previous convictions.

 

The Committee is requested to consider whether this applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the driver was a fit and proper person to hold a hire car vehicle driver’s licence in view of the applicants convictions for a number of offences.

 

The Committee interviewed the applicant in relation to these matters.

 

RESOLVED – That the application be granted.

Case No P1677

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of an incident relating to the conduct of a licensed private hire driver.

 

The Committee is requested to consider whether this applicant is a fit and proper person to continue to hold a hire car vehicle driver’s licence and what action, if any, to take.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the driver was a fit and proper person to continue to hold a hire car vehicle driver’s licence in view of his recent conduct.

 

The Committee interviewed the applicant in relation to these matters.

 

RESOLVED – That a warning letter be sent to the driver and placed on file relating to his future conduct.

Case No P1681

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of the proposed licensed hire car vehicle driver’s previous convictions.

 

The Committee is requested to consider whether this applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the applicant remained a fit and proper person to continue to hold a hire car driver’s licence.

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That in the light of the driver’s failure to notify the licensing authority of his conviction, the driver’s licence should be suspended for a two week period.

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of the conduct of an existing driver.

 

The Committee is requested to consider whether this driver remains a fit and proper person to hold a licensed private hire vehicle license and what action to take, if any, against the driver.
