To approve as a correct record and sign the minutes of the meeting held on 29 July 2015.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 29 July 2015 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 6,7, 8, 9, 10 and 11 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Items 6-11 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicants and would breach their Data Protection principles.

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

 

Minutes:

Councillors and Officers were invited to declare any interests they had in any of the items on the agenda for the meeting.

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken urgent action to suspend 7 hire car driver’s licences.

 

RESOLVED – to note the urgent decisions.

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

6.

CASE NUMBER P1562

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report advises members of a licensed hire car driver’s recent conviction.

 

The Committee is requested to consider what action to take, if any, with regard to the information contained within the report.

RESOLVED – That consideration of this item be deferred pending the driver’s attendance at the Committee.

CASE NUMBER P1563

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report details an application for the grant of a Licensed Hire Car Driver’s Licence after consideration of the information contained in the Disclosure and Barring Service.

 

The committee is requested to consider whether or not to grant this application.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the applicant was a fit and proper person to hold a Licensed Hire Car Driver’s Licence after consideration of the information contained in the Disclosure and Barring Service disclosure.

 

The Committee interviewed the applicant, who was accompanied by a friend, in relation to these matters.

 

RESOLVED – That the application be granted.

CASE NUMBER P1564

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report details an application for the grant of a Licensed Hire Car Driver’s Licence after consideration of the information contained in the Disclosure and Barring service.

 

The Committee is requested to consider whether to grant this application.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether or not the applicant was a fit and proper person to hold a Licensed Hire Car Driver’s Licence after consideration of the information contained in the Disclosure and Barring Service disclosure.

 

The Committee interviewed the applicant, who was accompanied by two members of his family, in relation to this matter.

 

 RESOLVED – That the Committee was of the view that the applicant had failed to demonstrate to the satisfaction of the Committee that he was a fit and proper person to be licensed as a Hire Car Driver by virtue of the applicant’s convictions in relation to perverting the course of justice and plying for hire and consequently having no insurance.

CASE NUMBER P1565

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report details an application for the grant of a Licensed Hire Car Driver’s Licence after consideration of the information contained in the Disclosure and Barring Service.

 

The Committee is requested to consider whether to grant this application.

CASE NUMBER P1567

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report advises members of a Family Court Finding of Fact Judgement against a Stockport licensed taxi driver.

 

The Committee is requested to consider whether or not the driver is a fit and proper person to continue to hold a hire car driver’s licence.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether or not the driver was a fit and proper person to continue to hold a hire car driver’s licence following a Family Court Finding of Fact Judgement.

 

The Committee interviewed the driver, who was accompanied by his wife and his solicitor, in relation to these matters.

 

RESOLVED – (6 in favour, 3 against) that the hire car driver be authorised to continue to hold his licence.

11.

CASE NUMBER P1568

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report advises members of a licensed hire car driver’s police caution and his failure to notify the licensing authority of the caution.

 

The Committee is requested to consider whether or not to driver is a fit and proper person to continue to hold a hire car driver’s licence.

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That no further action be taken.
