To approve as a correct record and sign the minutes of the meeting held on 26 March 2014.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 23 March 2014 were approved as a correct record and signed by the Chair.

 

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of items (if any) on the agenda which are marked "not for publication" by virtue of the categories set out in the Local Government Act 1972 (as amended).

 

Minutes:

RESOLVED - That the public be excluded from the meeting during consideration of items 8 -11 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicants and would breach their Data Protection principles.

4.

Urgent Decisions

To report that the Corporate Director for Place Management and Regeneration has taken urgent action in consultation with the Chair of the Licensing, Environment and Safety Committee to suspend one Private Hire Car Driver’s licence.

 

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director had, in consultation with the Chair, taken urgent action to suspend one hire car driver’s licence pending receipt of a Disclosure and Barring Service report.

 

RESOLVED – That the urgent decision be noted.

 

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report seeks approval on a proposal to reposition the existing Warren St Promotional Area Consent Street site as a result of the realignment of Warren Street and the junction with Bridge Street and Merseyway.

 

The Committee is recommended to approve the proposal to reposition the existing Warren Street Promotional Area Consent Street site as a result of the realignment of Warren Street and the junction with Bridge Street and Merseyway as detailed in paragraphs 3.2.1 and 3.2.2 of the report.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) detailing a proposal to reposition the existing Warren Street Promotional Area Consent Street site as a result of the realignment of Warren Street and the junction with Bridge Street and Merseyway.

 

RESOLVED – That approval be given to:-

 

(i) The proposal to reposition the existing Warren Street Promotional Area Consent Street site as a result of the realignment of Warren Street and the junction with Bridge Street and Merseyway.

 

(ii) Change the designation of the site at Merseyway, Stockport identified in the location plan in Appendix B of the report, from its current status as a Prohibited Street to Consent Street for street trading under Schedule 4 of The Local Government (Miscellaneous Provisions) Act 1982 including all roads, footways or other areas adjacent to the streets within 25 metres identified in the plan. The description of the area being:

 

A rectangular shaped area 30.25m x 12m lying between Merseyway, Bridge Street and Warren Street. The designated area is 4.0m from the front of the shop premises and 2.0m from the access road and Bridge Street kerb lines.

 

(iii) The Corporate Director Place Management and Regeneration to issue the necessary notices required under the Local Government (Miscellaneous Provisions) Act 1982.

The report details the introduction of licensing arrangements and conditions to regulate Street Collections and House to House Collections in Stockport.

 

The Committee is recommended to agree the introduction of licensing arrangements for Street Collections and House to House Collections.

The Committee is recommended to consider what action to take, if any, with regard to the driver’s conviction.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the driver to continue to be licensed as a private hire car driver following his conviction for offences of plying for hire, having invalid insurance and failing to wear his driver’s identification badge.

 

The Committee interviewed the driver in relation to these matters, who was accompanied by a relative during consideration of these matters. 

 

RESOLVED – That in the light of the driver’s conviction for offences of plying for hire, having invalid insurance and failing to wear his driver’s identification badge the driver’s licence be suspended for a one week period.

The Committee is recommended to consider what action to take, if any, with regard to the driver’s conviction.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the driver to continue to be licensed as a private hire car driver following his caution for an offence. 

 

The driver submitted additional information which he requested the Committee to give consideration to prior to the determination of the matter.

 

The Committee interviewed the driver in relation to this matter.

 

RESOLVED – That notwithstanding the driver’s caution, the Committee was satisfied that the driver was a fit and proper person to continue to be licensed as a Private Hire Driver in Stockport and that a note be placed on the driver’s file for information detailing the nature of the driver’s caution.
