To approve as a correct record and sign the minutes of the meeting held on 24 April 2013.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 24 April 2013 were approved as a correct record and signed by the Chair.

 

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of items (if any) on the agenda which are marked "not for publication" by virtue of the categories set out in the Local Government Act 1972 (as amended).

 

Minutes:

RESOLVED - That the public be excluded from the meeting during consideration of items 9 –12 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicants and would breach their Data Protection principles.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

6.

Licensing Of Domestic Premises For The Home Boarding Of Cats And Dogs pdf icon PDF 23 KB

To consider a report of the Service Director (Place Management).

 

The report details the introduction of licensing arrangements and conditions to regulate the home boarding of dogs. 

 

The Committee is recommended to:-

 

(1) Agree the introduction of licensing arrangements for the home boarding of dogs.

(2)The proposed conditions be adopted.

(3)The power to issue the licence be delegated to the Corporate Director and any Officer designated in writing by them.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing the introduction of licensing arrangements and conditions to regulate the home boarding of dogs. 

 

RESOLVED – (1) That the Committee gives approval to:-

 

(i) The introduction of licensing arrangements for the home boarding of dogs as detailed in the report.

 

(ii) The adoption of domestic premises for the home boarding of dogs as detailed in the report be adopted.

 

(iii) The power to issue licences for the domestic home boarding of dogs under the Animal Boarding Establishment Act 1963 be delegated to the Corporate Director for Place Management and Regeneration and any Officer designated in writing by him.

 

(2) That the Service Director (Place Management) be requested to investigate the licensing of domestic premises for the home boarding of cats and report back to a future meeting of the Licensing, Environment & Safety Committee.

To consider a report of the Service Director (Place Management).

 

The report details the introduction of licensing arrangements and conditions to regulate the performance of stage hypnotism. 

 

The Committee is recommended to:-

 

(1) The introduction of licensing arrangements for the authorisation of stage hypnotism.

(2) The proposed conditions be adopted.

(3) The power to grant the licence be delegated to the Corporate Director and any Officer designated in writing by them.

The report details the intention to carry out a full review of all operator, driver and vehicle licence conditions, including a period of formal consultation with interested parties.  

 

The Committee is recommended to note the report.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing the intention to carry out a full review of all operator, driver and vehicle licence conditions, including a period of formal consultation with interested parties.  

 

RESOLVED – That the report be noted and that drivers for taxis and private hire be consulted on Hackney Carriages vehicles licensed by Rossendale Borough Council operating as private hire vehicles in Stockport.

To consider a report of the Service Director (Place Management).

 

The report provides details of a proprietor of a Stockport Council Licensed Private Hire Operator’s recent conviction.

 

The Committee is recommended to consider what action to take, if any, with regard to the proprietor’s conviction.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing a recent conviction of a proprietor of a Stockport Council Licensed Private Hire Operator.

 

The Committee interviewed the proprietor in relation to this matter.

 

RESOLVED – That the Committee was satisfied that the proprietor was a fit and proper person to continue to be licensed as a Private Hire Operator in Stockport and that a note be placed on the proprietor’s file for information.

The report details an application for the grant of a licensed hire car driver’s licence.

 

The Committee is recommended to consider whether or not the applicant is a fit and proper person to hold a drivers licence.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the applicant to be licensed as a private hire car driver following convictions being disclosed on a Disclosure and Barring Service check.

 

The applicant submitted additional information which he requested the Committee to give consideration to prior to the determination of the application.

 

The Committee interviewed the applicant in relation to these matters.

 

 RESOLVED – That the application be granted.

The Committee is recommended to consider what action to take, if any, with regard to the hackney carriage driver’s suspension.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing the suspension of a hackney carriage driver.

 

The driver submitted additional information which he requested the Committee to give consideration to prior to the determination of his suspension.

 

The Committee interviewed the driver in relation to this matter.

 

RESOLVED – That the Committee was of the view that the driver had failed to demonstrate to the satisfaction of the Committee that he was a fit and proper person to continue to be licensed as a hackney carriage driver by virtue of the driver’s recent medical assessment and accordingly the driver’s suspension be continued until such a point that he had submitted a further medical assessment attesting to his being fit to drive a licensed hire car vehicle.
