To approve as a correct record and sign the minutes of the meeting held on 24 October 2012.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 24 October 2012 were approved as a correct record and signed by the Chair.

 

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of items (if any) on the agenda which are marked "not for publication" by virtue of the categories set out in the Local Government Act 1972 (as amended).

 

Minutes:

RESOLVED - That the public be excluded from the meeting during consideration of items 6 –12 to prevent the disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information because disclosure of the personal information would not be fair to the applicants and would breach their Data Protection rights.

 

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

5.

Hackney Carriage Licences issued by Rossendale Council

Minutes:

(NOTE: The Chair was of the opinion that this item, although not included on the agenda for the meeting, should be considered as a matter of urgency in accordance with Section 100B(4)(b) of the Local Government Act 1972 in order to prevent any unnecessary inconvenience to the applicant).

 

A representative of the Service Director (Place Management) reported that Hackney Carriage licences issued by Rossendale Council could operate as a private hire car driver in Greater Manchester and in other parts of the country. He confirmed that the Enforcement Team was investigating the issue and that

a report would be submitted to a future meeting updating the Committee on this issue.

 

RESOLVED – That the information be noted.

 

6.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

Case No. P1496

To consider a report of the Service Director (Place Management).

 

The report requests the Committee to give consideration to the continuance of a driver’s licence following a conviction for an offence.

 

The Committee is recommended to consider whether or not the applicant is a fit and proper person to continue to hold a hire car driver’s licence.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Committee to consider whether the driver was a fit and proper person to continue to hold a hire car driver’s licence following a conviction for a serious offence.

 

The Committee interviewed the driver in relation to this matter who was accompanied by his legal representative. 

 

The driver’s legal representative submitted additional information which was considered by the Committee prior to the determination of the application.

 

RESOLVED – That the application be granted and that a note be placed on the driver’s record detailing the background to the continuous of the driver’s hire car licence.

To consider a report of the Service Director (Place Management).

 

The report details an application for the grant of a licensed hire car driver’s licence.

 

The Committee is recommended to consider whether or not the applicant is a fit and proper person to hold a drivers licence.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the applicant to be licensed as a private hire car driver following convictions for a number of offences being disclosed on a CRB check.

 

The Committee interviewed the driver in relation to these matters who was accompanied by his legal representative. 

 

The applicant’s legal representative submitted additional information which was considered by the Committee prior to the determination of the application.

The report details information which has been disclosed at the discretion of the Chief Officer of Greater Manchester Police on a CRB check.

 

The Committee is recommended to consider whether or not the applicant is a fit and proper person to continue to hold a hire car driver’s licence.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the driver to continue to be licensed as a Hackney Carriage driver following the receipt  of information disclosed at the discretion of the Chief Officer of Greater Manchester Police. 

 

The Committee interviewed the driver in relation to this matter.

 

The driver submitted additional information which was considered by the Committee prior to the determination of the application.

 

RESOLVED – That no further action be taken.
