To approve as a correct record and sign the minutes of the meeting held on 25 April 2018.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 25 April 2018 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda item 6 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Items 6-13 to prevent the disclosure of information relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicant and would breach their data protection principles.

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Councillors and Officers were invited to declare any interests which they may have had in any of the items on the agenda for the meeting.

 

No declarations were received.

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken action to suspend 53 hire car drivers’ licences and revoke 2 hire car drivers’ licences.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

6.

Case No P1660

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of an existing driver’s manner of driving.

 

          The Committee is requested to consider what action, if any, to take in regard to the above and possible consideration of a further driving assessment to be undertaken by the driver at their own expense.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the driver was a fit and proper person to continue to hold a hire car vehicle driver’s licence in view of the complaints received about his manner of driving.

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That the driver’s licence be suspended with immediate effect in the interests of public safety.  The licence will remain suspended until such time that the Local Authority receives a medical report which satisfies them that the driver is fit to drive a private hire car vehicle.  The Local Authority will insist on informing any medical examiner of the circumstances that have led to this suspension and any questions that need to be addressed.  The driver must also complete a driver’s assessment.

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of a new applicant’s lack of understanding of both the spoken and written word in English.

 

The Committee is requested to consider whether the applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which informed Members of the new applicant’s lack of understanding of both the spoken and written word in English.  The Committee was requested to consider whether the driver was a fit and proper person to hold a hire car vehicle driver’s licence.

 

The Committee interviewed the driver, who was accompanied by his daughter, in relation to these matters.

 

RESOLVED – That the driver needed a little more time to develop his understanding of English and that he should complete a further English Language course and then reapply.

The report informs Members of the conduct of a new applicant.

 

The Committee is requested to consider whether the driver is a fit and proper person to continue to hold a hire car driver’s licence.

The Committee is requested to consider whether the driver is a fit and proper person to continue to hold a hire car driver’s licence.

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That the driver should receive a formal written warning relating to his future conduct.

To consider a report of the Corporate Director for Place Management ad Regeneration.

 

The report informs Members of the proposed licensed hire car vehicle driver’s previous convictions.

 

The Committee is requested to consider whether this applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

The Committee interviewed the applicant in relation to these matters.

 

RESOLVED – That the application be granted.
