Licensing Act 2003: Application for a Timed Premises Licence at Whitebottom Farm, Compstall (continued)

Minutes:

The Sub-Committee noted that those objectors present, having considered the applicant’s additional representation, had subsequently consented to the continuation of the hearing, and therefore proceeded to consider the application.

 

The applicant advised the Sub-Committee that they wished to submit information additional to that which was received in advance of the hearing for the Sub-Committee’s consideration, namely a letter received from Greater Manchester Fire and Rescue Service.  The representative of the Democratic Services Manager confirmed that the consent of all parties present at the hearing had been given to the consideration of the additional documentary information in accordance with Section 18 of The Licensing Act 2003 (Hearings) Regulations 2005.

 

The applicants attended the meeting and answered Councillors’ questions in relation to the application.  Three objectors also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  There were no representations made by any responsible authority.

 

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)           Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)          Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that concern had been expressed in relation to the ability for emergency vehicles to gain access to the site.  However, the Sub-Committee noted with approval the content of the applicant’s operating schedule with regard to this licensing objective and the additional supporting letter from Greater Manchester Fire and Rescue Service which had been circulated at the meeting and determined that no further conditions were necessary in order to address this objective.

 

(iv)         Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that that amplified live music had the potential to disturb local residents and the potential for litter generation.  The Sub-Committee noted with approval the content of the applicant’s operating schedule with regard to this licensing objective, but determined that in order to properly address the licensing objective, it would be necessary to impose further conditions on the licence, namely:-

 

(a) that, in consultation with representatives of Compstall Community Council, appropriate signage be erected throughout the event site advising patrons to leave the event quietly and to respect local neighbours;

 

(b) that, in consultation with representatives of Compstall Community Council, appropriate signage be erected warning local residents and visitors to the Etherow Country Park that the route leading to the event site may be traversed by vehicles more frequently during the lead up to and for the duration of the event.

 

(c) that the applicant liaise with the Council’s Environmental Health Team in relation to the setting of appropriate noise limits generated by amplified live music for the duration of the event.

 

(d) that the updated management plan document be circulated to the relevant responsible authorities in advance of the event taking place.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol on the premises be approved as follows:-

 

18:00 hours to 23:00 hours, on Friday 26 July 2013

12:00 hours to 23:00 hours, on Saturday, 27 July 2013

11:00 hours to 17:00 hours on Sunday, 28 July 2013

 

(2) That the hours for the performance of live music, indoors and outdoors, be approved as follows:-

 

18:00 hours to 00:00 hours, on Friday 26 July 2013

12:00 hours to 00:00 hours, on Saturday, 27 July 2013

11:00 hours to 18:00 hours on Sunday, 28 July 2013

 

(3) That the hours for the playing of recorded music, indoors and outdoors, be approved as follows:-

 

18:00 hours to 00:00 hours, on Friday 26 July 2013

12:00 hours to 00:00 hours, on Saturday, 27 July 2013

11:00 hours to 18:00 hours on Sunday, 28 July 2013

 

(4) That the hours for the provision of late night refreshment, indoors and outdoors, be approved as follows:-

 

23:00 hours to 00:00 hours, on Friday 26 July 2013

23:00 hours to 00:00 hours, on Saturday, 27 July 2013

 

(5) That the stated, standard opening hours be noted as follows:-

 

18:00 hours to 00:00 hours, on Friday 26 July 2013

12:00 hours to 00:00 hours, on Saturday, 27 July 2013

11:00 hours to 18:00 hours on Sunday, 28 July 2013

 

(6) That an SIA licensed security firm be employed to control the guests in attendance at the event.

 

(7) That a full management plan with a risk assessment and detailing first aid cover, fire protection policies and full evacuation procedures be put in place and that the updated management plan document be circulated to the relevant responsible authorities in advance of the event taking place.

 

(8) That only plastic glasses and bottles be used.

 

(9) That appropriate plans be made for access by emergency vehicles into the compound.

 

(10) That the event team in line with the security staff monitor the guests.

 

(11) That the sound levels from the PA system be monitored to avoid any noise and complaints from residential properties.

 

(12) That any children who attend the event are requested to be accompanied by a responsible adult. In addition all children's activities will be staffed by CRB checked and staff members.

 

(13) That the security team closely monitor children on site.

 

(14) That no children be allowed to enter an area where alcohol is on sale.

 

(15) That wristbands be issued at the entrance to the event and that any individual who looks under the age of 25 will be asked for identification. The identification that shall be accepted are passports, photocard driving licences and PASS accredited cards and no photocopies shall be accepted.

 

(16) That, in consultation with representatives of Compstall Community Council, appropriate signage be erected throughout the event site advising patrons to leave the event quietly and to respect local neighbours;
