Licensing Act 2003: Application for a Timed Premises Licence at Romiley Golf Club, Goosehouse Green, Romiley

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report details an application from Pitch Productions Ltd for a timed premises licence to be granted under the Licensing Act 2003 at Romiley Golf Club, Goosehouse Green, Romiley for an event to be held on the 19 September 2020.  The application proposes the following:-

 

·         The supply of alcohol on the premises Saturday 19th September 12:00 to 23:00 hours.

·         The provision of live music (outdoors) Saturday 19th September 10:00 to 23:00 hours.

 

The Sub-Committee is recommended to consider the application for a Timed Premises Licence to be granted at Romiley Golf Club, Goosehouse Green, Romiley.

Minutes:

A representative of the Corporate Director for Place Management & Regeneration submitted a report (copies of which had been circulated) detailing an application received on behalf of Pitch Productions Ltd for a timed premises licence to permit the supply of alcohol on the premises on Saturday, 19 September between 12:00 to 23:00 hours; and the provision of live music (outdoors) on Saturday, 19 September between 10:00 to 23:00 hours at Romiley Golf Club, Goosehouse Green, Romiley for an event to be held on the 19 September 2020.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.  At this stage in the proceedings, the applicant also informed the Sub-Committee that they would offer an amendment to their application to include additional conditions: -

 

·         requiring the provision of CCTV at the entrance and exit to the site;

·         the relocation of the toilet facilities to the opposite side of the field away from residential properties;

·         to specify that the perimeter of the site shall be enclosed; and

·         to provide dedicated security at the property at Brakanes, Cowlishaw Brow at all hours the event is open to the public.

 

Three objectors to the proposal, having previously submitted a written representation in relation to the application, explained their objection and answered Councillors’ questions in relation to the application.

 

There were no objections made by any responsible authority.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Digital, Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)        Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)       Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)      Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, specifically the representations raised concerns about the access for emergency vehicles, arrangements for medical care, evacuation procedures and the safety of patrons leaving the site late at night. 

 

However, the Sub-Committee noted with approval the content of the applicant’s detailed and comprehensive operating schedule in relation to this licensing objective and specifically highlighted the emergency evacuation procedures and the proposals for the provision of welfare facilities.  Further, the Sub-Committee noted that the applicant had offered to amend their application to include a further condition requiring the provision of CCTV at the entrance and exit to the site.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, specifically the representations raised concerns in relation to noise nuisance, anti-social behaviour, traffic generation, litter generation and the provision of toilet facilities. 

 

However, the Sub-Committee noted with approval the content of the applicant’s detailed and comprehensive operating schedule in relation to this licensing objective and specifically highlighted the arrangements for the monitoring of noise both before and during the event and the traffic management plan.  Further, the Sub-Committee noted that the applicant had offered to amend their application to include further conditions in relation to the relocation of the toilet facilities to the opposite side of the field away from residential properties; to specify that the perimeter of the site shall be enclosed; and to provide dedicated security at the property at Brakanes, Cowlishaw Brow at all hours the event is open to the public which would service to obviate many of the concerns expressed by the objectors.

 

The Sub-Committee was therefore of the view that there were no further conditions that were both necessary and appropriate in order to address the prevention of public nuisance and public safety licensing objectives.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol for consumption on the premises to be approved between 12:00 to 23:00 hours on Saturday, 19 September 2020.

 

(2) That the hours for the provision of live music (outdoors) be approved from 10:00 to 23:00 hours on Saturday, 19 September 2020.

 

(3) That approval be given to the imposition of those conditions proposed by the applicant, both as part of the original application and the amendments proposed at the meeting, to appear on the premises licence in addition to the mandatory conditions.
