Licensing Act 2003: Application for a Review of the Premises License at The Full Shilling, 11 Tiviot Dale

To consider a report of the Service Director (Place Management).

 

The report details an application from the Police Licensing Officer for a review of the Premises Licence for the Full Shilling, 11 Tiviot Dale.  The original review hearing was adjourned from the 27 July 2011 to give the parties an opportunity to agree suitable conditions to put before the Committee for approval.  These conditions have now been agreed.

 

The Sub-Committee is recommended to consider the application for the review of the Premises Licence at The Full Shilling and the subsequent agreed conditions by the DPS and the Police.

Minutes:

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing an application from the Chief Officer of Greater Manchester Police, being a responsible authority under the Licensing Act 2003 exercising its statutory function to prevent crime and disorder and to protect public safety, for a review of the premises licence for the Full Shilling, 11 Tiviot Dale under Section 51 of the Licensing Act 2003.

 

The Sub-Committee was advised that the application had previously been submitted to a meeting of the Sub-Committee on 27 July 2011 at which it was reported that solicitors for the Designated Premises Supervisor at the Full Shilling had requested that consideration of this application be deferred in accordance with Section 11(1) of the Licensing Act 2003 (Hearings) Regulations 2005 pending the Designated Premises Supervisor being available to attend a reconvened meeting of the Sub-Committee.  The representative of the Chief Officer of Greater Manchester Police indicated that he consented to the request.

 

Following ongoing discussions, a schedule of conditions had now been agreed by all parties and were submitted to the Sub-Committee for their approval.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder and prevention of public nuisance licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

RESOLVED – That having heard the application for a review of the premises licence at Full Shilling, 11 Tiviot Dale made by the Chief Office of Greater Manchester Police, and having considered all the evidence presented, the Sub-Committee was satisfied that the premises had been associated with disorder on and in the vicinity of the premises.  However, the Sub-Committee noted with approval the content of the proposed schedule of conditions agreed between the licensee and Greater Manchester Police, namely:-

 

(1) That a digital hard drive CCTV system shall be in operation to cover internal and external areas of the premises.  Any area where customers have legitimate access must be sufficiently illuminated for the purposes of CCT.  All CCTV recorded images shall have sufficient clarity/ quality/ definition to enable facial recognition.  CCTV shall be kept in an unedited format for a period of 30 days, any DVDs subsequently produced shall be in a format so it can be played back on a standard personal computer or standard DVD player.  Any person left in charge of the premises must be trained in the use of any such CCTV equipment and able to produce/ download/ burn CCTV images upon request from a person from a responsible authority.  CCTV shall be maintained on a regular basis and kept in good working order.  CCTV maintenance records to be kept, details of contractor used and work carried out to be recorded.  A plan indicating the position of CCTV cameras to be submitted to the Police Licensing Officer.  Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc) a secure storage system to store those recording mediums shall be provided.  A CCTV monitor must be working at all the times the premises is open to members of the public.  This monitor must be clearly position at the bar, displaying real time images from the CCTV cameras so clientele in the premises are aware that CCTV is in operation.

 

(2) A Challenge 25 scheme shall be operated at the premises.  The only form of valid identification being passport, photo driving licence, PASS hologram ID card or National Identity Card if it has a PASS hologram.  Notices shall be displayed in prominent positions at the premises indicating that the Challenge 25 Policy is in force.  All staff shall be trained and shall undergo regular refresher training from a personal licence holder in respect of the Challenge 25 Policy  and form of acceptable ID, age identification, awareness/ prevention of proxy sales.  Such training sessions shall be recorded in a training book which shall include a record of each member of staff together with the date the training took place, the details of the training provided and the name of the personal licence holder providing the training.  The training book shall be kept on the premises and made available to responsible authorities upon request.  Training shall be refreshed every 3 to 4 months.  Training shall also include underage saes, drunkenness and drugs and a risk assessment in the event of a funeral, celebratory event i.e. birthday/ wedding etc or where the premises has reached the maximum occupancy level.

 

(3) The premises will not allow any drinks to be taken outside of the premises, except into the beer garden.

 

(4) The premises will display signs requesting that customers wishing to smoke should use the beer garden.
