Licensing Act 2003: Application for a New Premises Licence at Blanc de Blancs Ltd, 8 Ack Lane East, Bramhall

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report details an application from Blanc de Blancs Ltd for a new premises licence to include the supply of alcohol for consumption on and off the premises at 8 Ack Lane East, Bramhall.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Blanc de Blancs Ltd, 8 Ack Lane East, Bramhall.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Blanc de Blancs Ltd for a new premises licence to include the supply of alcohol for consumption on and off the premises at 8 Ack Lane East, Bramhall.

 

The applicants and an objector attended the meeting and answered Councillors’ questions in relation to the application.

 

The Sub-Committee noted that a further objection had been submitted to the application, and although duly notified of the date and time of the hearing had they attended the hearing in person.  The Sub-Committee therefore considered the objection on the basis of the written submission.

 

There were no representations made by any responsible authority. 

 

At this point in the proceedings, the applicant indicated that they wished to amend their application to reduce the proposed hours for the sale of alcohol for consumption on and off the premises to between 09.00 hours and 23:00 hours, Monday to Sunday.

 

The objector in attendance at the hearing, thereupon withdrew their objection to the application. 

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there had been incidents of violent behaviour and general disorder associated with the operation of other licensed premises within Bramhall Village and there was a concern that the addition of a further licensed premises would contribute to an increased risk of such incidents.  However, the Sub-Committee noted with approval the content of the applicant’s operating schedule in relation to this licensing objective and determined that no further conditions were necessary in order to address this objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there had already been problems of noise disturbance associated with the operation of other licensed premises within Bramhall Village and there was a concern that the addition of a further licensed premises would contribute to an increased risk of such incidents.  However, the Sub-Committee noted with approval the content of the applicant’s operating schedule in relation to this licensing objective and determined that no further conditions were necessary in order to address this objective.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol by retail sale for consumption on and off the premises be approved from 09:00 to 23:00 hours, Monday to Sunday.

 

(2) That the stated, standard opening hours be noted as being from 09:00 to 23:00 hours, Monday to Sunday.

 

(3) That an incident book be kept on site.

 

(4) That staff training on the licensing objectives, antisocial behaviour management and the Blanc de Blanc Alcohol Policy be documented.

 

(5) That CCTV cameras be provided at the front and rear of the premises and at the bar/till area and that images shall be downloadable by duty manager during opening hours and shall be kept for 30 days.

 

(6) That a Challenge 25 policy be in force at the premises.

 

(7) That a refusals register be kept by all staff for instances when a person cannot produce recognised proof of age once challenged.

 

(8) That no bottles shall be disposed of outdoors between 21:30 hours and 08:00 hours each day.

 

(9) That the external seating area shall be regularly cleared of cigarette butts.

 

(10) That the external seating area shall be cleared and vacated of customers by 21.00 hours each day.

 

(11) That the Licensing, Environment & Safety Committee be recommended to request that the Corporate Director for Place Management & Regeneration investigate the potential of amending and including within the Council’s Licensing Policy a cumulative impact policy for designated local and district centres within the Borough.
