The Minutes (copies of which had been circulated) of the meeting held on 31 July 2013 were approved as a correct record and signed by the Chair.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting, at local information and advice centres and via the Council’s website at www.stockport.gov.uk/publicquestions

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of agenda item 5 (Appeal 260) which contains information “not for publication” by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection regulations.

Appeal A260

To consider a grievance appeal from an employee of the Office of the Chief Executive.

The Committee considered a grievance appeal from an employee of the Office of the Chief Executive. The appellant and his representative attended the meeting and presented his case. 

 

RESOLVED – The Committee considered the grievance appeal, presentation and the written documentation that was submitted and heard Management’s response.  Having listened to all that was said and having read the documentation, the Committee found that:-

 

(i) The Employer had the discretion to decide who goes into the Pool.

 

(ii) In respect of the process, the Committee considered that it was applied fairly and consistently.  Management was entitled to undertake a competitive interview process and appoint the candidate it considered to be best for the job.

 

(iii) The Committee upheld the view that Management reached, which was efforts had been made to retain the status quo. 

 

In light of these factors the Committee upheld Management’s decision and resolved that the appeal be dismissed.
