To approve as a correct record and sign the Minutes of the meeting held on 31 May 2012.

The Minutes (copies of which had been circulated) of the meeting held on 31 May 2012 were approved as a correct record and signed by the Chair.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Minutes:

No declarations of interest were made.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting and at local information and Advice Centres).

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of item 5 on the agenda which are marked “not for publication by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection.

Appeal A258

To consider a dismissal appeal from an employee of Services for People.

 

This item is confidential and has been circulated to Councillors only.

Minutes:

The Committee considered an appeal against dismissal from an employee of Services to People. The appellant did not attend but had requested that in their absence the appeal be dealt with by written representation. The Committee received documents and heard management’s presentation.

 

RESOLVED – The Committee was of the view that having read, questioned and heard all of the evidence submitted including that submitted in writing in advance of the hearing and from those present at the hearing that:-

 

(i)    the employee was not fit to return to their present role and that they had made that clear to management.

 

(ii)   the employee’s continued absence was due to work related stress and there was no reasonable adjustment that could have been made to the role.

 

(iii)  management had tried to find suitable redeployment and that a suitable job had been found, that was appropriate to skills and experience but understood that the employee rejected that option.

 

(iv)  it was acknowledged that management had been left with no other option than to terminate employment.

 

In the light of these factors the Committee determined that the appeal be dismissed.
