To approve as a correct record and sign the Minutes of the meeting held on 9 February 2012.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 30 January 2012 were approved as a correct record and signed by the Chair.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Minutes:

No declarations of interest were made.

3.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting and at local information and Advice Centres.)

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of item 5 on the agenda which is marked ‘not for publication’ by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection

Appeal A256

To consider a dismissal appeal from an employee of Services to Place.

 

This item is confidential and has been circulated to Councillors only.

Minutes:

The Committee considered an appeal against dismissal from an employee of Services to Place.  The appellant and their son attended the meeting and presented the case.  The Committee received documents, heard presentations and questioning from the appellant and management. 

 

The Committee agreed the following:-

 

1.  The Committee was clear that it was only considering absences that occurred over the most recent twelve month period.

 

2.  The Committee accepted that the employee had only attended for work during that period for 36 days.

 

3.  The Committee accepted that the employee had a history of mental health related problems that preceded that date and that probably amounted to a disability.

 

4.  That, on balance, the Committee considered that management provided the employee with appropriate and reasonable support to overcome their difficulties over a long period of time, but particularly over the last twelve months. 

 

5.  The Committee acknowledged the previous good service record of the employee.

 

RESOLVED – That having read all of the evidence submitted, listened to and questioned all of the testimony of both parties the appeal be dismissed.
