Election of Chair

To elect a Chair of this committee for the period until the next Annual Council meeting (giving effect to the allocations determined by the Annual Council meeting on 17 May 2011 and nomination of the relevant party group).

RESOLVED – That Councillor Dean Fitzpatrick be elected Chair for the duration of the municipal year.

Councillors and officers to declare any interest which they may have in any of the items on the agenda for the meeting.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice.  (Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting and at local information and Advice Centres.)

To consider whether it is in the public interest to exclude the public during the consideration of item 5 on the agenda which are marked "not for publication" by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED - That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent the disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection.

Appeal A254

To consider a grievance appeal from an employee of Corporate and Support Services.

 

This item is confidential and has been circulated to Councillors only.

Minutes:

The Committee considered a grievance appeal from an employee of Corporate and Support Services. The Appellant and their representative attended the meeting and presented the case. The Committee received document bundles, heard presentations and questioning from the Appellant and Management and heard evidence from a witness.

 

RESOLVED - The Committee considered the grievance appeal, presentation and the written documentation that was submitted and heard management’s response. Having listened to all that was said and having read all the documentation the Committee found that :-

 

  1. The meeting of 30 November was a team information sharing meeting not the start of the redundancy consultation process. Following that meeting appropriate processes were followed.

 

  1. Whilst the business case appears to miss a section the Committee determined that as this was a post with only one member of staff it was not a significant matter.

 

  1. The Council’s disciplinary process was overseen by HR and was not misused.

 

  1. The Committee were not convinced that there was any evidence of victimisation or abuse of position as all processes were overseen by HR and senior managers.

 

The Committee therefore resolved that the appeal be dismissed.
