The Minutes (copies of which had been circulated) of the meeting held on 22 June 2011 were approved as a correct record.

Agenda item 5 – ‘Appeal against the termination of an introductory tenancy’ as she was acquainted with the appellant.

Councillor Rowles left the meeting and took no part in the discussion or vote on this item. (see Minutes 5 and 7 below).

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the

consideration of items (if any) on the agenda which are marked "not for publication" by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

REOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information because disclosure of the personal information would be unfair to the appellant and breach their data protection rights.

The Committee was advised that the appellant’s solicitor had requested an adjournment on 17 September 2012 in order to seek full instructions from the appellant.

 

RESOLVED – That the meeting be adjourned to enable the appellant’s solicitor to seek full instructions from the appellant.

Appeal against the Termination of an Introductory Tenancy (Continued)

Minutes:

Representatives of the Service Director (Place Development) and of the Chief Executive, Stockport Homes attended the meeting and submitted a report (copies of which had been circulated) explaining the reasons for the decision to terminate an Introductory Tenancy on the appellant. They also answered Councillors' questions and questions from the appellant’s solicitor.

 

The appellant’s solicitor attended the meeting, presented their case and answered Councillors' questions.

 

Having considered the evidence presented both in writing and at the meeting, the Panel:-

 

RESOLVED – That the decision to terminate an Introductory Tenancy be upheld.
