To consider a report of the Service Director (Place Management).

 

The report details an application from Mr Michael Gibbs for a new premises licence for the provision of regulated entertainment (films, indoor sporting events, live and recorded music), the provision of entertainment facilities for dancing and the supply of alcohol at Marple Conservative Club, 119 Church Lane, Marple.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Marple Conservative Club.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Michael Gibbs for the provision of regulated entertainment (films, indoor sporting events, live and recorded music), the provision of entertainment facilities for dancing and the supply of alcohol at Marple Conservative Club, 119 Church Lane, Marple.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.  The applicant confirmed that the application related solely to that part of the premises which comprised ‘Shelby Hall’ which formed the first floor of the building.

 

The Sub-Committee was advised that the objector to the application had advised the Licensing Authority in advance of the hearing that he would not be in attendance at the meeting and asked the Sub-Committee to consider his objection on the basis of his written submission.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that it was asserted that the premises had been responsible for problems with noise which emanated from within the premises when the windows were open and from patrons and vehicles leaving the premises late at night.  The Sub-Committee noted with approval the content of the applicant’s operating schedule, but determined that in order to properly address this licensing objective it would be necessary to impose a further condition to require that all windows be closed after 23.00 hours.

 

It was then

 

RESOLVED – (1) That the hours for the exhibition of films and indoor sporting events be approved from 10.00 to 23.00 hours, Monday to Saturday; and from 10.00 to 22.00 hours on Sunday.

 

(2) That the hours for the performance of live music, the playing of recorded music and the provision of facilities for dancing be approved from 10.00 to 23.00 hours, Monday to Thursday and Sunday; and from 10.00 to 00.00 hours, Friday and Saturday.

 

(3) That the hours for the supply of alcohol for consumption on the premises be approved as follows:-

 

·         10.00 to 23.30 hours, Monday to Thursday and Sunday.

·         10.00 to 00.00 hours, Friday and Saturday.

·         10.00 to 01.30 hours the following day on New Years Eve.

 

(4) That the stated, standard opening hours be noted as follows:-

 

·         10.00 to 23.30 hours, Monday to Thursday and Sunday.

·         10.00 to 00.00 hours, Friday and Saturday.

·         10.00 to 01.30 hours the following day on New Years Eve.

 

(5) That exterior lighting be in situ to monitor arrivals and departures at the premises main entrance, function hire room entrance and parking areas. 

 

(6) That club management, supervisor and staff be informed of the objectives of the Licensing Act 2003 and the statutory requirement to comply with the relevant provisions of the Act.

 

(7) That the club’s constitution include rules governing the conduct of members and their guest’s private hire of the function room. 

 

(8) That employees be instructed not to admit or serve anyone who is behaving in a disorderly fashion and that misconduct be reported to the club’s management to consider under club rules.
