Licensing Act 2003: Application for a Variation of the Premises Licence at the Palace Bar, Mill Street. pdf icon PDF 34 KB

To consider a report of the Service Director (Environment).

 

The report details an application from Status Investments Ltd for the variation of the premises licence at The Palace Bar, Mill Street to extend the indoor music and dance hours so that they are in line with the alcohol hours. 

 

The Sub-Committee is asked to consider the application for a variation of the premises licence at The Palace Bar.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Status Investments Ltd for variations to the premises licence to extend the hours for indoor music and dance so that hey were in line with the hours for the supply of alcohol at Palace Bar, Mill Street, Woodley.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.  A representative of Stockport Council’s Environmental Health & Trading Standards service attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the existing noise levels from the premises have an effect on local residents and that this would be exacerbated should the hours for indoor music and dance be extended.  The Sub-Committee was further advised that evidence had been collected which demonstrated that the premises were breaching existing conditions on their licence in relation to noise limitation.  The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective, but determined that in order to properly address this licensing objective it would be necessary to reduce the number of days upon which the proposed extension of the hours for indoor music and dance from seven days a week to Friday and Saturday.

 

It was then

 

RESOLVED – (1) That the hours for indoor music and dance be approved as follows:-

 

(i)         19.00 to 00.00 hours Friday and Saturday.

(ii)        19.00 to 23.00 hours Sunday to Thursday.

(iii)       19.00 to 01.00 hours the following day on New Years Eve and Christmas Eve.

(iv)       19.00 to 00.00 hours on Sundays preceding a Bank Holiday Monday.

 

(2) That a sound limiter be in operation and level records to be kept for a minimum of three months.
