Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 21 May 2012 were approved as a correct record and signed by the Chair.

Exclusion Of The Public And The Public Interest Test

To consider whether it is in the public interest to exclude the public during the

consideration of Agenda Item 5 (Licensing Act 2003: Application For A Review Of The Premises License At The Moor Suite, Heaton Moor) as an appendix to the report contains information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of

Data Protection principles.

 

Minutes:

RESOLVED – That in order to prevent the disclosure of information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of Data Protection principles, the public be excluded from the meeting during part of Agenda Item 6 (Licensing Act 2003: Application for a Review of the Premises Licence at the Moor Suite, Heaton Moor).

Application For A Review Of The Premises License At The Moor Suite, Heaton Moor pdf icon PDF 60 KB

To consider a report of the Service Director (Place Management).

 

The report details an application from Karen Dyson, Manager of the Environment Team for Environmental Health & Trading Standards, on behalf of The Head of Environmental Health & Trading Standards at Stockport Council for a review of the Premises Licence for The Moor Suite.

 

The Sub-Committee is recommended to consider the application for the review of the Premises Licence at The Moor Suite.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing an application from Karen Dyson (Environment Team Manager) on behalf of The Head of Environmental Health & Trading Standards at Stockport Council being a responsible authority under the Licensing Act 2003 exercising its statutory function to prevent public nuisance for a review of the Premises Licence at The Moor Suite, Heaton Moor.

 

A representative of The Head of Environmental Health and Trading Standards and persons making relevant representations in addition to the Licence Holder attended the meeting and answered Councillors’ questions in relation to the application.

 

The Sub-Committee heard submissions from the representative of the Head of Environmental Health and Trading Standards that that there had been numerous incidents of noise nuisance associated with the premises dating back to 2007.  The Sub-Committee was further advised that at its meeting on 20 December 2011, following a previous review of the premises licence at the Moor Suite, a number of additional conditions were imposed on the premises licence to ameliorate the problems that had previously been experienced at the premises.  The representative of the Head of Environmental Health and Trading Standards stated that the premises had failed to comply fully with the conditions that had been imposed, namely that since the last review instances of noise nuisance had been observed by Environmental Health which would not be possible had the conditions relating to the use of the noise limiter been observed.

RESOLVED - That the meeting be adjourned pending the submission of additional information relating to confirmation of the correct operation of the installed Sound Limiting Device at the premises and that there were no other plug sockets in operation for sound equipment to powered through.

 

At 7.37 pm on 12 September 2012 the meeting reconvened.

Application For A Review Of The Premises License At The Moor Suite, Heaton Moor (continued)

Minutes:

The Sub-Committee was advised that subsequent to the adjournment of the meeting of the Sub-Committee on 28 June 2012, representatives of Environmental Health and Trading Standards and the Police Licensing Officer had visited the premises on 31 August 2012 and found that the premises were compliant with the conditions stipulated on the premises licences.  It was further noted that there had been no further complaints received in relation to the operation of the premises.  The Sub-Committee was advised that in the light of this, Environmental Health and Trading Standards were of the view that there were no outstanding issues that remained to be resolved at the premises.

RESOLVED – That the in the light of the evidence received by the Sub-Committee from Environmental Health and Trading Standards in relation to the operation of the premises since the adjournment of the meeting, that no further action be taken.
