Licensing Act 2003: Application for a Review of the Premises Licence at Premier (Formerly known as the Wine Rack) 200-202 Stockport Road, Marple pdf icon PDF 29 KB

To consider a report of the Service Director (Place Management).

 

The report provides the details of a Consent Order approved by Stockport Magistrates Court on 26 February 2012 in respect of Premier, 200-202 Stockport Road, Marple.

 

The Sub-Committee is recommended to consider the Consent Order approved by the Magistrates Court on 26 February 2012 in respect of Premier, 200-202 Stockport Road, Marple.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to formally agree to the consent order approved by the Magistrates Court on the 23 January 2012.

 

It was reported that on the 27 July 2011 a review hearing was held before the Licensing Sub-Committee following an application submitted by Greater Manchester Police to review the premises licence.  Following representations made by all parties at the hearing the Sub-Committee decided to impose conditions on the grounds of prevention of crime and disorder and protection of children from harm and the Premises Licence Holder subsequently appealed to Stockport Magistrates Court.

 

Following discussion between the parties the Licensing Authority reviewed its decision and an agreement was reached between the parties. The Magistrates Court on 23 January 2012 made a Consent Order requiring:

 

·        That CCTV be installed at the premises which shall include coverage of the   main till area and rear external area of the shop. 

·        That CCTV is in operation and recording at all times the premises are open to the public and said recordings to be made available to the police, licensing authority and trading standards upon request.  Images must be retained unedited for 30 days. 

·        That a refusals book is used and accurate records are kept at all times which shall include the date of the attempted sale; the person who refused the sale; the reason the sale was refused; the item attempted to be purchased; and a description of the person attempting to purchase which will include the general description of the person.  These records are to be made available to the Police, licensing authority and trading standards upon request.

·        That all staff be trained on a three monthly basis by the Premises Licence Holder on the use and retrieval of CCTV footage; challenge 25 and the use of the refusals book.  Written records of this training must be kept and made available to the police, licensing authority and trading standards. 

·        That a written record is maintained of all staff who work at the premises which should include their full names, date of birth, home address, contact details, start date of employment and the date when the employment was terminated.  These records are to be made available to the police, licensing authority and trading standards upon request.

·        That all staff responsible for making sales of alcohol will be trained and will obtain a Personal Licence within 3 months of them first being employed at the store.

 

RESOLVED - That the consent order approved by the Magistrates Court on the 23 January 2012 regarding Premier, formally known as the Wine Rack as set out above, be noted
