The Minutes (copies of which had been circulated) of the meeting held on 27 June 2011 were approved as a correct record and signed by the Chair.

Licensing Act 2003: Application for Variation to the Premises Licence at Curry Max, 288 Gorton Road, Reddish pdf icon PDF 88 KB

To consider a report of the Service Director (Place Management).

 

The report details an application from Nasir Hussain and Nigath Sultana for the variation of the premises licence to extend the hours for the provision of late night refreshment at Curry Max, 288 Gorton Road, Reddish.

 

The Sub-Committee is recommended to consider the application for the variation of the premises licence at Curry Max.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Nasir Hussain and Nigath Sultana for the variation of the premises licence to extend the hours for the provision of late night refreshment at Curry Max, 288 Gorton Road, Reddish.

 

Representatives of the applicants attended the meeting and answered Councillors’ questions in relation to the application.

 

A representative of Greater Manchester Police attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that the premises had previously provided late night refreshment without a licence and that during those hours of unlicensed operation the police had recorded a number incidents both in and in the immediate vicinity of the premises.

 

The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective, but determined that in order to properly address this licensing objective it would be necessary to impose an additional condition on the licence, namely that the premises install a further CCTV camera to cover the frontage of the premises on Gorton Road.

 

The Sub-Committee noted that the existing premises licence had been granted with a condition that recordings from the CCTV system be kept for a period of 31 days and that they should be made available to the police upon request.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, but noted with approval the content of the applicant’s operating schedule in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, but noted with approval the content of the applicant’s operating schedule in respect of this licensing objective.

 

It was then

 

RESOLVED – (1) That the hours for the provision of late night refreshment indoors be approved as follows:-

 

·         23.00 to 00.00 hours, Monday to Wednesday.

·         23.00 to 00.30 hours, Thursday and Sunday.

·         23.00 to 02.00 hours, Friday and Saturday.

 

(2) That the stated, standard opening hours to the public be noted as follows:-

 

·         16.30 to 00.30 hours, Monday to Wednesday.

·         16.30 to 01.00 hours, Thursday and Sunday.

·         16.00 to 02.30 hours, Friday and Saturday.

 

(3) That an operational CCTV system be installed at the premises and that said CCTV be recorded on a hard disc.

 

(4) That clear signage be displayed highlighting that CCTV is in operation.

 

(5) That the premises install a further CCTV camera to cover the frontage of the premises on Gorton Road.

 

(6) That it be noted that the existing premises licence had been granted with a condition that recordings from the CCTV system be kept for a period of 31 days and that they should be made available to the police upon request.

 

(7) That fire extinguishers be provided on site.

 

(8) That a first aid box and book be provided on site.

 

(9) That clear signage be erected and encouragement given to customers for them to respect the neighbourhood and dispose of their litter in the bins provided.

 

(10) That routine litter picks be undertaken on the pavements in the immediate vicinity of the premises.

The report details an application from Habibur Rahman for the variation of the premises licence to extend the hours for the provision of late night refreshment at Moonlight, 278 Gorton Road, Reddish.

 

The Sub-Committee is recommended to consider the application for the variation of the premises licence at Moonlight.
