The Minutes (copies of which had been circulated) of the meeting held on 29 June 2011 were approved as a correct record and signed by the Chair.

Licensing Act 2003: Application for a Review of the Premises Licence at the Full Shilling, 11 Tiviot Dale pdf icon PDF 100 KB

To consider a report of the Service Director (Place Management).

 

The report details an application from the Police Licensing Officer for a review of the Premises Licence for the Full Shilling, 11 Tiviot Dale.

 

The Sub-Committee is recommended to consider the application for the review of the Premises Licence at The Full Shilling, Tiviot Dale.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing an application from the Chief Officer of Greater Manchester Police, being a responsible authority under the Licensing Act 2003 exercising its statutory function to prevent crime and disorder and to protect public safety, for a review of the premises licence for the Full Shilling, 11 Tiviot Dale under Section 51 of the Licensing Act 2003.

 

The representative of the Service Director (Place Management) reported that solicitors for the Designated Premises Supervisor at the Full Shilling had requested that consideration of this application be deferred in accordance with Section 11(1) of the Licensing Act 2003 (Hearings) Regulations 2005 pending the Designated Premises Supervisor being available to attend a reconvened meeting of the Sub-Committee.  The representative of the Chief Officer of Greater Manchester Police indicated that he consented to the request.

 

RESOLVED – That consideration of this item be deferred in accordance with Section 11(1) of the Licensing Act 2003 (Hearings) Regulations 2005 pending the Designated Premises Supervisor being available to attend a reconvened meeting of the Sub-Committee.

Licensing Act 2003: Application for a Premises Licence at Huffy's Bar and Restaurant pdf icon PDF 99 KB

To consider a report of the Service Director (Place Management).

 

The report details an application from Hough Enterprises Ltd for the supply of alcohol for consumption on the premises, the performance of live music on the premises, the playing of recorded music in the premises and the provision of late night refreshment on the premises.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Huffys Restaurant & Bar.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Hough Enterprises Ltd for the supply of alcohol for consumption on the premises, the playing of recorded music in the premises and the provision of late night refreshment on the premises at Huffy’s Bar and Restaurant, 32 Great Underbank, Stockport.

 

The applicant and an objector to the application attended the meeting and answered Councillors’ questions in relation to the application.  There were no representations made by any responsible authority.

 

The applicant indicated that he wished to amend his application to include the following conditions:-

 

·         That there be 24 hour video camera surveillance, with 28 day recording, and that said recordings be provided to the police upon request.

·         That there be ‘Think 25’ policy training for all staff serving alcohol, with documentary evidence of said training to be provided to the police upon request.

·         That a personal licence holder be on site at all times of licensable activities.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that obstruction of the adjacent passageway had the potential to hinder fire escape routes by employees and customers of nearby businesses.  The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective and accepted the conditions that had been volunteered by the applicant to the Sub-Committee, but determined that in order to properly address this licensing objective it would be necessary to impose an additional condition on the licence, namely that there be no storage other than within the premises so as to keep fire escape routes open.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

RESOLVED – (1) That the hours for the supply of alcohol be approved from 09.00 hours to 01.00 hours, Monday to Sunday.

 

(2) That the hours for the performance of live music be approved from 20.00 hours to 23.00 hours, Thursday to Sunday.

 

(3) That the hours for the playing of recorded music be approved from 09.00 hours to 23.00 hours, Monday to Sunday.

 

(4) That the hours for the provision of late night refreshment be approved from 09.00 hours to 01.00 hours, Monday to Sunday.

 

(5) That the stated, standard opening hours of the premises to the public be noted as 09.00 hours to 01.00 hours, Monday to Sunday.

 

(6) That alcohol not be served to patrons who appear to be intoxicated.

 

(7) That toilets at the premises be regularly inspected for any drug usage.

 

(8) That signage be displayed at the premises indicating the maximum number of persons permitted on the premises and that staff monitor numbers.

 

(9) That staff be trained on how to handle intoxicated people.

 

(10) That signage be displayed requesting that patrons leave the premises quietly.

 

(11) That staff be trained not to serve patrons who appear to be intoxicated.

 

(12) That persons under the age of 18 must be accompanied by an adult.

The report details an application from the Police Licensing Officer for a review of the Premises Licence for Premier (formerly known as the Wine Rack), 200-202 Stockport Road, Marple.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) detailing an application from the Chief Officer of Greater Manchester Police, being a responsible authority under the Licensing Act 2003 exercising its statutory function to prevent crime and disorder and the protection of children from harm, for a review of the premises licence under Section 51 of the Licensing Act 2003.

 

A representative of the Chief Officer of Greater Manchester Police, and the Licence Holder and his representative attended the meeting and answered Councillors’ questions in relation to the application.

 

The Sub-Committee heard submissions from the representative of the Chief Officer of Greater Manchester Police that there had been a number of allegations that the premises had repeatedly supplied age restricted products to under age persons and had subsequently failed to submit copies of CCTV footage to the police upon request so as to prove or disprove the allegations.

 

The Sub-Committee was requested to give consideration to the imposition of a number of additional conditions upon the licence, namely:-

 

·         That CCTV be installed at the premises which shall include coverage of the main till area and rear external area of the shop.

·         That CCTV is in operation and recording at all times the premises are open to the public and said recordings to be made available to the police, licensing authority and trading standards upon request.  Images must be retained unedited for 30 days.

·         That a refusals book is used and accurate records are kept at all times which shall include the date of the attempted sale; the person who refused the sale; the reason the sale was refused; the item attempted to be purchased; and a description of the person attempting to purchase which will include the sex, height and general description of the person and clothing.  These records are to be made available to the police, licensing authority and trading standards upon request.

·         That all staff be trained on a three monthly basis by the Premises Licence Holder on the use and retrieval of CCTV footage; Challenge 25 and the use of the refusals book.  Written records of this training must be kept and made available to the police, licensing authority and trading standards upon request.

·         That a Personal Licence Holder be on the premises at all times the premises are undertaking licensable activities.

·         That a written record is maintained of all staff who work at the premises which should include their full names, date of birth, home address; contact details; start date of employment and the date when employment was terminated and the reasons for this.  These records are to be made available to the police, licensing authority and trading standards upon request.

·         That the Premises Licence Holder agree to random ultra-violet bottle marking by the police or local authority which may take place without prior notice to the Licence Holder and without obstruction by any person working at the premises. 

·         That the premises report to the appropriate school or Education Welfare Officer if there are children on the premises during school hours.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder licensing objective in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.
