In accordance with the Executive’s decision of 1 October 2013, the Chief Executive, in consultation with the Executive Councillor (Economic Development and Regeneration) has approved the following in relation to the Compulsory Purchase Orders and Side Road Orders needed for A6 to Manchester Airport Relief Road Scheme:-
Being satisfied that all necessary measures have been put in place and that the Metropolitan Borough Council of Stockport (in its own behalf and acting as agent for Cheshire East Borough Council and Manchester City Council under the provisions of an agreement under Section 8 of the Highways Act 1980), approval is hereby given for -
1. the Council Solicitor to make and submit to the Secretary of State for Transport for confirmation, a Side Roads Order under Sections 8, 14 and 125 of the Highways Act 1980 and all other powers enabling them in that behalf, in relation to the proposed construction of a new classified A6, Hazel Grove, Stockport to Manchester Airport relief road, designed to improve, stop up and construct lengths of highway and to stop up and provide new means of access to premises to support the proposed construction of the relief road and
2. that pursuant to the aforementioned authority to make a Side Roads Order, the Council Solicitor to make and submit to the Secretary of State for Transport for confirmation an Order under Sections 8, 239, 240, 246, 250 and 260 of the Highways Act 1980 and all other powers enabling them in that behalf, to purchase compulsorily the land and new rights contained within the attached plan and shown coloured pink and blue and described below for the purpose of -
a) the construction of a highway from a point on the new length of the A6 Buxton Road, Stockport to be constructed between Yew Tree Lane, Stockport and Norbury Hollow Road, Stockport extending generally westwards to a point on the A555 Manchester Airport Eastern Link Road 520 metres west of the A5102 Woodford Road, Bramhall, Stockport;
b) the improvement of the A555 Manchester Airport Eastern Link Road from its junction with the A5102 Woodford Road, Bramhall, Stockport to its junction with the B5338 Wilmslow Road, Handforth, Cheshire;
c) the construction of a highway from a point on the A555 Manchester Airport Eastern Link Road 356 metres east of the B5338 Wilmslow Road, Handforth, Cheshire extending generally westwards, to a point on Ringway Road in Wythenshawe, Manchester, 200 metres east of the junction of Ringway Road with Ringway Road West;
d) the construction, improvement and diversion of highways and the provision of new means of access to premises in the Metropolitan Borough of Stockport, in the City of Manchester and in the Parishes of Poynton-with-Worth, Handforth, and Styal, in the Borough of Cheshire East;
e) the diversion of watercourses and the execution of other works on watercourses in connection with the construction and improvement of highways and the execution of other works mentioned above;
f) use by the Metropolitan Borough Council of Stockport in connection with such construction and improvement of highways and the execution of other works mentioned above; and
g) the mitigation of any adverse effects which the existence or use of the highways proposed to be constructed or improved will have on their surroundings;
h) to enter to construct, inspect and maintain the works mentioned above.
3. The Council Solicitor to apply to the Secretary of State for Communities and Local Government for a Certificate pursuant to Section 19(1)(a) of the Acquisition of Land Act 1981 to authorise the Metropolitan Borough Council of Stockport to acquire land used for public recreation and needed to facilitate the proposed relief road in exchange for land which is no less in area and equally advantageous as the land taken.
The Executive Meeting considered a report on the submission of the planning application for the proposed A6 to Manchester Airport Relief Road and the requirements for compulsory purchase orders, side road orders and changes to the rights of way network that would be required as a result of the scheme, and agreed that:-
(1) approval be given to the preferred scheme for the A6 to Manchester Airport Relief Road and the submission of the planning application, with approval of the final plans, planning submission and associated assessment documents being delegated to the Chief Executive in consultation with the Executive Councillor (Economic Development & Regeneration); and
(2) in order to ensure the delivery of the Manchester Airport Relief Road approval be given to the making of the necessary associated compulsory purchase orders, side road orders and public rights of way changes, including diversions and changes of status from footpath to bridleway with detailed reports on these orders being agreed with the Chief Executive and Executive Councillor (Economic Development & Regeneration).
