Licensing Act 2003: Application for a new Premises Licence at Seven Miles Out, 20 Market Place, Stockport

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report details an application from Seven Miles Out Arts CIC for a new Premises Licence to be granted to include the supply of alcohol for consumption on and off the premises, the performance of plays, films, live music, recorded music, dance or similar indoors and outdoors and the provision of late night refreshment indoors at Seven Miles Out, 20 Market Place, Stockport.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Seven Miles Out, 20 Market Place, Stockport.

Minutes:

A representative of the Corporate Director for Place Management & Regeneration submitted a report (copies of which had been circulated) detailing an application made by Seven Miles Out Arts CIC for a new Premises Licence to be granted to include the supply of alcohol for consumption on and off the premises, the performance of plays, films, live music, recorded music, dance or similar indoors and outdoors and the provision of late night refreshment indoors at Seven Miles Out, 20 Market Place, Stockport.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application. The Sub Committee also considered one written objection to the application. There were no representations made by any responsible authority.

 

The applicant informed the Sub-Committee that they wished to amend their application to reduce the proposed hours for the supply of alcohol by retail sale for consumption on and off the premises and the performance of live music to 11:00 to 23:30 hours, Monday to Sunday.

 

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport. However, the decision was reached on consideration of all arguments given in relation to this specific application.

 

The Sub- Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children from Harm

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective relating to the appropriateness of the usage of the licensed premises for events that were aimed at children.  The Sub-Committee noted with approval the content of the applicant’s operating schedule in relation to this licensing objective and, in addition those conditions proposed as part of the application.  However the Sub-Committee was of the view that in order to satisfactorily address the protection of children from harm licensing objective it would be necessary to impose a further condition as follows:-

 

“A Challenge 21 Scheme shall be operated at the premises. The only form of valid identification being passport, photo driving licence or identification that displays a holographic mark issued by a government authorised body/ agency.  Notices shall be displayed in prominent positions at the premises indicating that the Challenge 21Policy is in force. All staff shall be trained and shall undergo regular refresher training from a Personal Licence Holder in respect of the Challenge 21 Policy and forms of acceptable ID, age identification/ awareness.  Such training sessions shall be recorded in a training book which shall include a record of each member of staff together with the date the training took place, the details of the training provided and the name of the personal licence holder providing the training. The training book shall be kept on the premises and made available upon request to responsible authorities. Training shall be refreshed every 5 to 6 months.”

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol by retail sale for consumption on and off the premises be approved from 11:00 to 23:30 hours, Monday to Sunday.

 

(2) That the hours for the performance of live music indoors and outdoors be approved from 11:00 to 23:30 hours, Monday to Sunday.

 

(3) That the hours for the performance of plays, films, recorded music, dance or similar indoors and outdoors be approved from 11:00 to 00:00 hours, Monday to Sunday.

 

(4) That the hours for the provision of late night refreshment indoors be approved from 23:00 to 00:00 hours, Monday to Sunday.

 

(5) That the Designated Premises Supervisor ensure that staff are trained in the requirements of the Premises Licence.

 

(6) That the toilets be checked for drug activity and that a policy be put in place to deal with this.

 

(7) That there shall be vigilant checking of the Premises for hazards and any danger to safety.

 

(8) That bottles and glasses be removed on a regular basis.

 

(9) That windows and doors shall be kept closed other than access and egress.

 

(10) That the activity of customers outside the Premises be monitored so that it does not cause a disturbance.

 

(11) That all children aged 15 and under shall be accompanied by an adult.

 

(12) That there shall be no nudity or striptease allowed on the premises.

 

(13) That a Challenge 21 Scheme shall be operated at the premises.
