To consider whether it is in the public interest to exclude the public during consideration of agenda item 5 (Licensing Act 2003: Application for a Premises Licence at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport) as appendices to the report contain information ‘not for publication’ in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005 and where the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED – That notwithstanding the submission of information as part of Agenda Item 5 – ‘Licensing Act 2003: Application for a new Premises Licence at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that in the circumstances it was not necessary for the public to be excluded from the meeting.

Licensing Act 2003: Application for a new Premises Licence at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport pdf icon PDF 123 KB

To consider a report of the Corporate Director (Place) & Deputy Chief Executive.

 

The report details an application from Seven Miles Out for a premises licence to be granted under the Licensing Act 2003 at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport to permit the sale of alcohol on the premises only Friday* 1800-2100 hours, the performance of live music Friday* 1800-2100 hours, the performance of recorded music Friday* 1800-2100 hours and the performance of dance Friday* 1800-2100 hours.

 

* Denotes the last Friday of each month except for December when it will be the 3rd Friday of the month (for the purposes of clarity the licence application relates to 1 Friday per calendar month).

 

The Sub-Committee is recommended to consider the application for a Premises Licence to be granted at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport.

A representative of the Corporate Director (Place) and Deputy Chief Executive submitted a report (copies of which had been circulated) detailing an application from Seven Miles Out for a premises licence to be granted under the Licensing Act 2003 at Indoor Market Hall Market place, The Mile, Vernon Street, Bridge Street Brow, Mealhouse Brow, Little Underbank, Great Underbank, Stockport to permit the sale of alcohol on the premises only on  Fridays from 18.00 hours to 21.00 hours, the performance of live music on Fridays from 18.00 hours to 21.00 hours, the performance of recorded music on Fridays from 18.00 hours to 21.00 hours and the performance of dance on Fridays from 18.00 hours to 21.00 hours.

 

It was noted that the scope of the application related to the undertaking of licensable activity on the last Friday of each month only, except for December when it would be the third Friday of the month.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.

 

An objector to the proposal, having previously submitted written representations in relation to the application, also attended the meeting, explained their objections and answered Councillors’ questions in relation to the application.  The Sub-Committee also considered and were mindful of the further written representation that had been submitted in relation to this application.

 

There were no representations made by any responsible authority.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Digital, Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, specifically the representations asserted that the granting of the licence would compromise public safety by virtue of ongoing building works along the route of part of the proposed demarked ‘event area’.  However, the Sub-Committee was of the view that such works were temporary in nature and were not considered to constitute such a risk that the thoroughfare needed to be closed.  It was further noted that other food and drink operators were already utilising the carriageway in these locations for the operation of on street food and drink consumption.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, specifically the representations asserted that the granting of the licence would result in an increase in litter, food waste and associated pest control problems in the area.

 

However, the Sub-Committee noted with approval the content of the applicant’s operating schedule in relation to these licensing objectives which it considered would satisfactorily mitigate against the issues raised during the course of the hearing.  Specifically, the Sub-Committee recognised the waste control measures that would be implemented by the applicant and that the sale of alcohol was limited to the enclosed market hall building.

 

The Sub-Committee therefore determined that no further conditions were appropriate or necessary in order to address the prevention of the public nuisance and public safety licensing objectives.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol on the premises only be approved on Fridays from 18.00 hours to 21.00 hours.

 

(2) That the hours for the performance of live music be approved on Fridays from 18.00 hours to 21.00 hours.

 

(3) That the hours for the performance of recorded music be approved on Fridays from 18.00 hours to 21.00 hours
