The Minutes (copies of which had been circulated) of the meeting held on 10 September 2013 were approved as a correct record and signed by the Chair.

Licensing Act 2003: Application For A Premises Licence at Spiceland, 67a Wellington Road South pdf icon PDF 64 KB

The report details an application from Qasim Ellahi for a premises licence to be granted to include the supply of alcohol for consumption off the premises, from Monday to Sunday. 

 

The Sub-Committee is recommended to consider revising the permitted hours granted following withdrawal of an appeal.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) detailing an application made by Craig Gee & Co Solicitors on behalf of Qasim Ellahi for a Premises Licence to be granted, to include the supply of alcohol for consumption off the premises, from Monday to Sunday at Spiceland, 67A Wellington Road South, Stockport.

 

It was reported that the application had originally been considered by the Sub-Committee at its meeting on 10 September 2013, at which point it had been determined that relevant representations had been raised by Greater Manchester Police in respect of both the Crime and Disorder and Public Safety licensing objectives.  Specifically, with regard to the Crime and Disorder licensing objective, the Sub-Committee noted the following:-

 

·         there had been numerous evidenced incidents of anti-social behaviour associated with the consumption of alcohol within the immediate vicinity of the premises;

·         the position of the premises being located on a busy thoroughfare and adjacent to a popular bus stop in the town centre; and that

·         in the light of this evidence there was a significant and real risk of the existing problems being exacerbated.

 

The Sub-Committee was of the view that in order to properly address the Crime and Disorder licensing objective it would be necessary to reduce the proposed hours for the consumption of alcohol off the premises to 16:00 to 20:00 hours, Monday to Sunday.

 

The Sub-Committee also imposed two further conditions to address the technical limitations of the proposed CCTV system and concerns in relation to the training of staff to readily produce images from the CCTV system which had been raised under the Public Safety licensing objective.  The conditions imposed were as follows:-

 

·         That a CCTV security system be installed at the premises to a specification agreed with Greater Manchester Police in advance of the opening of the premises.

·         That any person left in charge of the premises must be trained in the use of any such equipment and must be able to produce CCTV images upon request.

 

It was reported that a written notice of the Sub-Committee’s decision was sent to the applicant on the 19 September 2013 who then subsequently exercised their right of appeal to the Magistrates Court. 

 

The representative of the Corporate Director for Place Management and Regeneration advised the Sub-Committee that the applicant’s representatives had, through the Licensing Authority, entered into negotiations with Greater Manchester Police relating to the proposed hours for the supply of alcohol

for consumption off the premises such that agreement had been reached  between both parties on the sale of alcohol between 16:00 and Midnight, Monday to Sunday.  The Sub-Committee was advised that the applicant would be minded to withdraw their appeal should the Sub-Committee give approval to the content of this negotiated settlement.

 

It was then

 

RESOLVED – (1) That in the light of the applicant and the sole objector, Greater Manchester Police, having arrived at a negotiated settlement with regard to the hours for the supply of alcohol for consumption off the premises, approval be given the amendment of the decision of the Sub-Committee of 10 September 2013 to the hours for the supply of alcohol for consumption off the premises at Spiceland, 67A Wellington Road South, Stockport to between 16:00 and Midnight, Monday to Sunday.

 

(2) That it be noted that all other conditions both offered by the applicant and imposed by the Sub-Committee pertaining to this application at its meeting of 10 September 2013 remain unaffected by this decision.
