To approve as a correct record and sign the Minutes of the meeting held on 3 July 2012.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 3 July 2012 were approved as a correct record and signed by the Chair.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public to exclude the public during consideration of agenda item 5 (Licensing Act 2003: Application for a premises licence at Compstall Cricket Club) as appendices to the report contains information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of Data Protection principles.

Minutes:

RESOLVED – That notwithstanding the submission of information as part of Agenda Item 5 - ‘Licensing Act 2003: Application For A Premises Licence To Be Granted At Compstall Cricket Club, Ernocroft Road’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that unless it was necessary for this information to be heard openly during the proceedings of the hearing, the public not be excluded from the meeting.

Councillors and officers are invited to declare any interests which they have in any of the items on the agenda for the meeting.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Sub-Committee on any matters within the powers and duties of the Sub-Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

Licensing Act 2003: Application for a Premises Licence at Compstall Cricket Club, Ernocroft Road pdf icon PDF 44 KB

The report details an application from Compstall Cricket Club for a premises licence to be granted to include the supply of alcohol, on the premises, from Monday to Sunday.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Compstall Cricket Club.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Compstall Cricket Club for a new premises licence for the supply of alcohol, on the premises.

 

The applicant and two persons making relevant representations to the application attended the meeting and answered Councillors’ questions in relation to the application.  There were no representations made by any responsible authority.  At this point in the proceedings, the applicant indicated that they wished to amend their application to reduce by one minute the hours for the supply of alcohol on Friday and Saturdays to midnight

 

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)         Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)       Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there had been instances in the past of occasional noise nuisance during periods when Temporary Event Notices had been issued for the premises and concern was expressed that these would increase should the premises licence be granted.

 

The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective, but determined that in order to properly address this licensing objective it would be necessary to impose further conditions, such that:-

 

(a) The premises place signs on the exits from the building and cricket ground encouraging patrons to be quiet until they leave the area and respect the local neighbours.

 

(b) The premises be required to maintain a complaints book on which all complaints pertaining to public nuisance made to the cricket club shall be recorded and made available to the police or the local authority upon request.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol on the premises be approved as follows:-

 

18:00 hours to 22:00 hours, Monday to Thursday

18:00 hours to 00:00 hours on Friday

12:00 hours to 00:00 hours on Saturday

12:00 hours to 22:00 hours on Sunday

 

(2) That it be noted that the proposing stated, standard opening hours of the premises will be as follows:-

 

18:00 hours to 22:00 hours, Monday to Thursday

18:00 hours to 00:00 hours on Friday

12:00 hours to 00:00 hours on Saturday

12:00 hours to 22:00 hours on Sunday

 

(3) That a Challenge 21 scheme shall be operated at the premises. The only form of valid identification being passport, photo driving licence or identification that displays a holographic mark issued by a government authorised body / agency.

 

(4) That notices be displayed in prominent positions at the premises indicating that the Challenge 21 Policy is in force. All staff shall be trained and shall undergo regular refresher training from a personal licence holder in respect of the Challenge 21 policy and forms of acceptable ID, age identification awareness/ prevention of proxy sales. Such training sessions shall be recorded in a training book which shall include a record of each member of staff together with the date the training took place, the details of the training provided and the name of the personal licence holder providing the training.
