To approve as a correct record and sign the Minutes of the meeting held on 17 February 2012.

The Minutes (copies of which had been circulated) of the meeting held on 18 February 2012 were approved as a correct record and signed by the Chair.

To consider whether it is in the public interest to exclude the public during the consideration of Agenda Item 5 (Licensing Act 2003: Application for a Variation of the Premises Licences at 120 Charles Street) as an appendix to the report contains information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of Data Protection principles.

RESOLVED – That notwithstanding the submission of information as part of Agenda Item 5 – ‘Licensing Act 2003: Application for a Variation of the Premises Licence at Bizoqya, 120 Charles Street’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that unless it was necessary for this information to be heard openly during the proceedings of the hearing, the public not be excluded from the meeting.

Councillors and officers are invited to declare any interests which they have in any of the items on the agenda for the meeting.

No declarations were made.

Members of the public are invited to put questions to the Chair and members of the Sub-Committee on any matters within the powers and duties of the Sub-Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

The report details an application from Sarmad Alwadi for the variation of the premises licence to change the start and extend the finish times for the provision of regulated entertainment including live music, recorded music and performance of dance; the provision of entertainment facilities for making music, dancing and anything of a similar description to making music and dancing; the provision of late night refreshment and the supply of alcohol on Friday and Saturday at 120 Charles Street.

The Sub-Committee is recommended to consider the application for the variation of the premises licence at 120 Charles Street.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Sarmad Alwadi for the variation of the premises licence to change the start and extend the finish times for the provision of regulated entertainment including live music, recorded music and performance of dance; the provision of entertainment facilities for making music, dancing and anything of a similar description to making music and dancing; the provision of late night refreshment and the supply of alcohol on Friday and Saturday at Bizoqya, 120 Charles Street..

The applicant attended the meeting and answered Councillors’ questions in relation to the application,

A number of objectors attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  The Sub-Committee noted that the Planning Authority had made a representation in respect of the application by virtue of the application site being subject to restrictions on its hours of use.

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

(i)         Crime and Disorder

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that residents had expressed concern that broken glass and debris would be strewn around the local roads and that cars will line the street and potentially be damaged due to the fact there is only one road leading to the premises which includes a sharp corner.  However, the Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective and determined that no further conditions were necessary in order to address this objective.

(ii)        Protection of Children

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

(iii)       Public Safety

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

(iv)       Public Nuisance

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that local residents were concerned that customers of Bizoqya entering and leaving the premises would creating noise in addition to amplified music disturbing local residents.

The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of this licensing objective and in particular that which related to the insulation of the property to prevent any disturbance to the outside surroundings, but determined that in order to properly address this licensing objective it would be necessary to it would be necessary to impose further conditions, such that:-

·         no patrons shall be permitted to enter the premises after 23.00 hours; and

·         that the hours for licensable activity on Friday and Saturday shall not be extended beyond 01.00 hours; and

·         that quarterly meetings be arranged with local residents.

It was then

RESOLVED – (1) That the hours for the supply of alcohol on the premises be approved as follows:-

·         11.00 to 23.30 hours, Sunday to Thursday.

·         13.00 to 01.00 hours Friday and Saturday.

(2) That the hours for the provision of late night refreshment indoors be approved as follows:-

·         11.00 to 23.30 hours, Sunday to Thursday.

·         13.00 to 01.00 hours Friday and Saturday.

(3) That the hours for the provision of live music, indoors; recorded music, indoors; dance, indoors, together with activity like music/ dance, indoors be approved as follows:-

·         11.00 to 23.30 hours, Sunday to Thursday.

·         13.00 to 01.00 hours Friday and Saturday.

(4) That the hours for the facilities for music, indoors; dance, indoors and facilities like music/ dance, indoors be approved as follows:-
