The minutes (copies of which had been circulated) of the meeting held on 20 May 2024 were approved as a correct record and signed by the chair.

Exclusion of the Public and Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of the application, as the report contained information ‘not for publication’ in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005, and where the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED – That the public be excluded from the meeting during the consideration of Agenda item 5 – ‘Application for the review of the premises licence under Section 53A of the Licensing Act 2003 (premises associated with serious crime and disorder) at Huffy’s at the Three Shires, 32 Great Underbank’ to prevent the disclosure of information relating to an individual in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005.  It would not, on balance, be in the public interest to disclose this information because disclosure of the personal information would not be fair to the applicant and would breach their data protection rights and the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Application for the review of the premises licence under section 53A of the Licensing Act 2003 (premises associated with serious crime or disorder) at Huffy's At The Three Shires, 32 Great Underbank

To consider a report of the Director of Place Management.

 

The Sub-Committee is recommended to consider the application from Greater Manchester Police for interim steps to be taken in relation to the premises licence Huffy’s at The Three Shires, 32 Great Underbank, SK1 1NR.

Minutes:

A representative of the Director for Place Management submitted a report (copies of which had been circulated) detailing an application from Greater Manchester Police for a summary review of the premises licence at Huffy’s at The Three Shires, 32 Great Underbank, SK1 1NR, and requesting that interim steps be taken by the Sub Committee pending determination of a full review of the premises licence.

 

In accordance with Section 53(A) of the Licensing Act 2003, the Licensing Authority had been requested by Greater Manchester Police to undertake a summary review of the premises licence at Huffy’s at The Three Shires, 32 Great Underbank, SK1 1NR, in light of allegations that the premises had been associated with serious crime.

 

A representative from Greater Manchester Police attended the meeting and answered questions in relation to the application for a summary review. The Premises Licence Holder, who was also the Designated Premises Supervisor, also attended the meeting and answered questions in relation to the summary review.

 

The Sub Committee, having heard the interested parties, proceeded to consider the prevention of crime and disorder licensing objective in respect of the review, together with the relevant parts of the council’s Licensing Policy and guidance from the Home Office. The decision was then reached on consideration of all arguments given in relation to this specific application.

RESOLVED – That, having heard the application for a summary review of the premises licence at Huffy’s At The Three Shires, 32 Great Underbank, SK1 1NR, made on behalf of the Chief Officer of Greater Manchester Police, and having considered all of the evidence presented, the Sub Committee was satisfied that the premises had been associated with serious crime.

 

The Sub Committee considered that the serious nature of the alleged incident coupled with concerns in relation to the significant failures in the effective management of the premises meant that it was necessary for the Sub Committee to take interim steps pending the final determination of the review.

 

The Sub Committee was of the view that, in order to satisfactorily promote the four licensing objectives, and in particular for the prevention of crime and disorder, it was appropriate and necessary to suspend the premises licence for all licensable activities pending the final determination of the review.
