RESOLVED – That, notwithstanding the submission of information as part of Agenda Item 5 – ‘Application to Vary the Premises Licence at The Club Hub (Heald Green) CIC, Sports Pavilion, Cross Road, Heald Green, Cheadle, Stockport, SK8 3LW’, which had been classified as ‘not for publication’ by virtue of it containing material which related to an individual, the Sub Committee was satisfied that in the circumstances it was not necessary for the public to be excluded from the meeting.

To consider a report of the Director of Place Management.

The report details an application from The Club Hub (Heald Green) CIC to vary the premises licence under the Licensing Act 2003 at The Club Hub (Heald Green) CIC, Sports Pavillion, Cross Road, Heald Green, Cheadle, Stockport SK8 3LW.

The Sub-Committee is recommended to determine the application to vary the premises license from The Club Hub (Heald Green) CIC in respect of The Club Hub (Heald Green) CIC, Sports Pavilion, Cross Rd, Heald Green, Cheadle, Stockport, SK8 3LW

A representative of the Director of Place Management submitted a report (copies of which had been circulated) detailing an application from The Club Hub (CIC) Heald Green for a variation of the premises licence under the Licensing Act 2003 at The Club Hub (Heald Green) CIC, Sports Pavilion, Cross Road, Heald Green, SK8 3LW which sought an extension of the hours for the sale of alcohol (on the premises) on Fridays from 18.00 to 00.00 hours; Saturday, from 13.00 to 00.00 hours; and on Christmas Eve and New Year’s Eve from 13.00 to 02.00 hours the following day; with all other hours remaining the same.

The applicant attended the meeting, presented their application, and answered Councillors’ questions in relation to the application.

Objectors to the proposal, having previously submitted a written representation in relation to the application also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

There were no representations made by any responsible authority.

The Sub Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and guidance from the Home Office. However, the decision was reached on consideration of all the arguments given in relation to this specific application.

The Sub Committee found the following:

(i)            Crime and Disorder

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

(ii)          Protection of Children from Harm

The Sub-Committee noted that a representation had been submitted on the basis that the application did not promote the protection of children from harm licensing objective.   However, the Sub-Committee was of the view that the representation related to matters of public nuisance and considered that it should be addressed as part of that licensing objective.

The Sub-Committee was therefore satisfied that no relevant representations had been raised in respect of this licensing objective.

(iii)         Public Safety

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

(iv)         The Prevention of Public Nuisance

The Sub-Committee was satisfied that relevant representations had been received in respect of this licensing objective, specifically the representations asserted that the granting of the variation would increase noise levels in the residential areas in the vicinity of the premises.

The Sub-Committee has noted with approval the content of the applicant’s operating schedule in respect of this licensing objective, specifically, the proposal to share contact details with nearby residents and take measures to reduce noise coming from the premises including the posting of notices at all exist requesting that patrons leave the premises quietly, the closing of windows and doors, and the undertaking of regular checks to ensure that sound disturbance is kept to a minimum.

However, it was determined that in order to properly address the prevention of public nuisance licensing objective, it would be necessary and appropriate to reduce the proposed hours for the supply of alcohol (on the premises) on:-

·         Friday and Saturday such that it terminated at 23.30 hours

·         Christmas Eve such that it terminated at 00.00 hours

·         New Year’s Eve such that it terminated at 01.30 hours

RESOLVED – (1) That the hours of the supply of alcohol (on the premises) be approved as follows:-

·         18.00 to 22.00 hours, Monday to Thursday

·         18.00 to 23.30 hours on Friday.

·         13.00 to 23.30 hours on Saturday

·         13.00 to 22.00 hours on Sunday.

·         13.00 to 00.00 hours on Christmas Eve.

·         13.00 to 01.30 hours on New Year’s Eve.

(2) That approval be given to the imposition of those conditions proposed by the applicant as part of the original application to appear on the premises licence in addition to the mandatory conditions.
