To consider whether it is in the public interest to exclude the public during consideration of the application, as appendices to the report contain information ‘not for publication’ in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005, and where the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED – That the public be excluded from the meeting during the consideration of Agenda item 5 – ‘Application to review the premises licence under Section 53A of the Licensing Act 2003 at Huffy’s at the Three Shires, 32 Great Underbank, SK1 1NB’ to prevent the disclosure of information relating to an individual in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005. It would not, on balance, be in the public interest to disclose this information because disclosure of the personal information would not be fair to the applicant and would breach their data protection rights and the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Minutes:

A representative of the Director of Place Management reported upon an application submitted on behalf of the Chief Officer of Greater Manchester Police (copies of which had been circulated) for a summary review of the Premises Licence at Huffy’s at The Three Shires, 32 Great Underbank, Stockport.

 

It was reported that the application had originally been submitted by Greater Manchester Police for an expedited summary review application under Section 53(A) of the Licensing Act 2003 for the same licence and heard by the Sub-Committee on 30 May 2024 and the Sub-Committee resolved to revoke the license in full as an interim measure.

 

In accordance with Section 53(C) of the Licensing Act 2003 the Licensing Authority was required to hold a full hearing to consider Greater Manchester Police’s application to undertake a full review of the premises licence at Huffy’s at The Three Shires, 32 Great Underbank, Stockport and any relevant representation.

 

The Licensing Authority had been requested by Greater Manchester Police to undertake a summary review of the premises licence in light of allegations that the premises had been associated with serious crime. The hearing was for the purpose of fully reviewing the license following the application and expedited hearing, to make a further decision in respect of the license.

 

A representative of Greater Manchester Police attended the meeting and answered Councillors’ questions in relation to the summary review.

 

The Premises License Holder also attended the meeting and answered Councillors’ questions in relation to the summary review.

 

The Sub-Committee, having heard the application proceeded to consider the review in light of the licensing objectives, particularly the prevention of crime and disorder licensing objective with the relevant parts of the council’s Licensing Policy and guidance from the Home Office. The decision was reached on consideration of all arguments and submissions given in relation to this specific application.

RESOLVED - Having heard an application for a review of the premises licence at Huffy’s at The Three Shires, 32 Great Underbank, Stockport, SK1 1NB made on behalf of the Chief Officer of Greater Manchester Police, the Sub-Committee was satisfied that the premises had been associated with serious crime.

 

The Sub-Committee considered the serious nature of the alleged incidents; the operation of the premises; and licensable activities outside of licensable hours, coupled with concerns in relation to the significant failures in the effective management and control of the premises means that it is necessary to revoke the premises license.

 

The Sub-Committee was of the view that, in order to satisfactorily promote the four licensing objectives, and in particular for the prevention of crime and disorder, it was appropriate and necessary to revoke the premises licence for all licensable activities.
