To consider whether it is in the public interest to exclude the public during consideration of agenda item 4 (Licensing Act 2003: Application for a Premises Licence to be granted at 19 Broadstone Road, North Reddish) as appendices to the report contain information ‘not for publication’ in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005 and where the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

That notwithstanding the submission of information as part of Agenda Item 5 – ‘Licensing Act 2003: Application for a Premises Licence to be granted at 19 Broadstone Road, North Reddish’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that in the circumstances it was not necessary for the public to be excluded from the meeting.

To consider a report of the Corporate Director (Place) and Deputy Chief Executive.

The report details an application received from Andrew Leslie Pass for a premises licence to be granted under the Licensing Act 2003 at 19 Broadstone Road, North Reddish to permit the supply of alcohol on and off the premises Monday to Thursday 13:30 to 23:00 hours, Friday to Saturday 12:00 to 00:00 and Sunday 12:00 – 23:00.

The Sub-Committee is recommended to consider the application for a Premises Licence to be granted at 19 Broadstone Road, North Reddish.

A representative of the Corporate Director (Place) and Deputy Chief Executive submitted a report (copies of which had been circulated) detailing an application received on behalf of Andrew Leslie Pass for a new premises licence to be granted at 19 Broadstone Road, North Reddish to permit the supply of alcohol on and off the premises Monday to Thursday 13:30 to 23:00 hours, Friday to Saturday 12:00 to 00:00 and Sunday 12:00 – 23:00.

The applicant attended the meeting and answered Councillors’ questions in relation to the application. An objector to the proposal, having previously submitted a written representation in relation to this application, also attended the meeting, explained their objection to the proposals and answered Councillors’ questions in relation to the application.

There were no representations made by any responsible authority.

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Digital, Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

The Sub-Committee found the following:-

(i)         Crime and Disorder

The Sub-Committee was satisfied that a relevant representation had been raised in respect of this licensing objective, specifically the representation asserted that the granting of the licence would result in an increase in crime, and specifically criminal damage, caused by patrons leaving the premises under the influence of alcohol.

(ii)        Protection of Children

It was noted that part of the representation that had been made related to the protection of children from harm licensing objective that the licensing authority had deemed to be not relevant in advance of the hearing and which were accordingly discounted as part of this determination.

The Sub-Committee was therefore satisfied that no relevant representations had been raised in respect of this licensing objective.

(iii)       Public Safety

It was noted that part of the representation that had been made related to the public safety licensing objective that the licensing authority had deemed to be not relevant in advance of the hearing and which was accordingly discounted as part of this determination.

The Sub-Committee was therefore satisfied that no relevant representations had been raised in respect of this licensing objective.

(iv)       Public Nuisance

The Sub-Committee was satisfied that a relevant representation had been raised in respect of this licensing objective, specifically the representation asserted that the granting of the licence would result in nuisance by way of noise caused by patrons entering and exiting the premises and from the use of the outside smoking area; and an increase in litter associated with the operation of the premises.

The Sub-Committee noted with approval the content of the applicant’s operating schedule with regard to both the prevention of crime and disorder and public nuisance licensing objectives, specifically that notices would be displayed to remind customers to leave quietly and that all litter would be cleared every day and bins would be provided in the outdoor areas.

While the Sub-Committee had great sympathy with the concerns expressed by the objector, it was of the view that there were no further conditions that were both necessary and appropriate in order to address the prevention of public nuisance and crime and disorder licensing objectives.

It was then

RESOLVED – (1) That approval be given to the hours for the supply of alcohol on and off the premises as follows:-

·         13:30 hours to 23:00 hours. Monday to Thursday

·         12:00 hours to 00:00 hours, Friday to Saturday; and

·         12:00 hours to 23:00 hours on Sunday.

(2) That approval be given to the imposition of those conditions proposed by the applicant as part of the application to appear on the premises licence in addition to the mandatory conditions.
