RESOLVED – That, notwithstanding the submission of information as part of agenda item 5 ‘Application to for a premises licence at Bredbury St Mark’s Cricket Club, Dark Lane, Bredbury, SK6 2BE’, which had been classified as ‘not for publication’ by virtue of it containing material which related to an individual, the Sub Committee was satisfied that in the circumstances it was not necessary for the public to be excluded from the meeting.

To consider a report of the Director of Place Management.

 

The report details an application from Pitch Productions Ltd. for a premises license under the Licensing Act 2003 for Bredbury St Mark’s Cricket Club, Dark Lane, Bredbury, SK6 2BE.

 

The Sub-Committee is recommended to determine the application for a premises license from Pitch Productions Ltd. in respect of Bredbury St Mark’s Cricket Club, Dark Lane, Bredbury, SK6 2BE.

A representative of the Director of Place Management submitted a report (copies of which had been circulated) detailing an application from Pitch Productions Ltd. for a new premises licence under the Licensing Act 2003 at Bredbury St Mark’s Cricket Club, Dark Lane, Bredbury SK6 2BE, which sought the following licensable activities for three days per calendar year:

 

·         Sale of alcohol (on the premises) on Friday 15:00 to 23:00 hours, Saturday 12:00 to 23:00 hours, and Sunday 12:00 to 22:30 hours.

·         Live & Recorded Music (indoors and outdoors) on Friday 15:00 to 23:00 hours, Saturday 12:00 to 23:00 hours, and Sunday 12:00 to 22:30 hours.

·         The provision plays, films and dance (indoors & outdoors) on Friday 15:00 to 23:00 hours, Saturday 12:00 to 23:00 hours, Sunday 12:00 to 22:30 hours.

 

The applicant attended the meeting, presented their application, and answered Councillors’ questions in relation to the application.

 

An objector, having previously submitted a written representation in relation to the application also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.

 

The Sub Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and guidance from the Home Office. However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub Committee found the following:

 

(i)            Crime and disorder

 

The Sub Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)          Protection of children from harm

 

The Sub Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that relevant representations had been received in respect of the public safety licensing objective, specifically the representations asserted that granting the application would: -

 

·         Increase the volume of cars in the area beyond available parking provision.

 

However, the Sub Committee noted with approval mitigations proposed by the applicant in respect of the public safety licensing objective, specifically that a shuttle bus would operate to and from the premises; that ticketed parking would be provided on other nearby sites following agreements with local organisations; and that cones would be positioned on Dark Lane so as to prevent all but residential parking.

 

The Sub-Committee therefore determined that no further conditions were appropriate or necessary in order to address the public safety licensing objective.

 

(iv)         The prevention of public nuisance

 

The Sub-Committee was satisfied that relevant representations had been received in respect of the prevention of public nuisance licensing objective, specifically the representations asserted that granting the application would: -

 

·         Increase noise levels in the vicinity of the premises, including for nearby residential areas.

 

However, the Sub Committee noted with approval mitigations proposed by the applicant in respect of the prevention of public nuisance licensing objective, specifically that outreach to the local community would feature in the run up to the three day event, including letter-drops residents in the area which would include a telephone number which could be reached at any time during the event; and the employment of a fully qualified sound engineer to measure sound levels in the area prior to the event and adjust the sound levels coming from the event accordingly.

 

The Sub-Committee therefore determined that no further conditions were appropriate or necessary in order to address the prevention of public nuisance licensing objective.

 

It was then

 

RESOLVED – (1) That approval be given to the hours for the supply of alcohol for consumption on the premises for three days per calendar year only, subject to the conditions proposed by the applicant, as follows: -

 

·         15:00 hours to 23:00 hours, Friday.

·         12:00 hours to 23:00 hours, Saturday.

·         12:00 hours to 22:30 hours, Sunday.
