DIVERSION OF A SECTION OF PUBLIC FOOTPATH 19 HAZEL GROVE AND BRAMHALL UNDER SECTION 119 OF THE HIGHWAYS ACT 1980

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report details a proposal to divert part of Public Footpath 19 Hazel Grove and Bramhall under Section 119 of the Highways Act 1980 as shown on the plan at Appendix 1.

 

The existing footpath currently runs south easterly (A-F) and then follows a line adjacent to the north side of the A6 Manchester Airport Relief Road (A6 MARR) (F-C), crosses the road via a tunnel beneath the road (C-D), and follows a line adjacent to the south side of the A6 MARR (D-E) and then continues from point E in an easterly direction. The footpath is unsurfaced between A – C and then surfaced from C – E.

The A6 MARR is a major carriageway and it is considered that diverting the footpath as it follows line A-B-C will be in the interests of the public because it keeps the footpath further away from the main road for that section and offers a more aesthetic aspect for pedestrians. It is also in the landowner’s interest as it follows the field edge rather than crossing the centre of the field, and the landowner has indicated that he has no objection to the diversion.

 

The Area Committee is recommended to resolve to authorise the making of an Order under Section 119 of the Highways Act 1980, diverting part of Public Footpath 19 Hazel Grove and Bramhall shown as a black solid line between Points A – F – C, to a route shown by a bold dashed line at Points A – B – C.

A representative of the Deputy Chief Executive submitted a report of the Corporate Director for Place Management & Regeneration (copies of which had been circulated) detailing a proposal to divert part of Public Footpath 19 Hazel Grove and Bramhall under Section 119 of the Highways Act 1980 as shown on the plan at Appendix 1. 

 

The report identified that it was considered that diverting the footpath would be in the interests of the public because it kept the footpath further away from the A6MARR relief road and offered a more aesthetic aspect for pedestrians. It was also in the landowner’s interest as it follows the field edge rather than crossing the centre of the field, and the landowner had indicated that they had no objection to the diversion.

 

RESOLVED – That authorisation be given to the making of an Order under Section 119 of the Highways Act 1980, diverting part of Public Footpath 19 Hazel Grove and Bramhall shown as a black solid line between Points A–F–C, to a route shown by a bold dashed line at Points A–B–C.
