The report details an application from Martin Healy for a premises licence to be granted under the Licensing Act 2003 at 6 Mealhouse Brow, Stockport.

 

The Sub-Committee is recommended to consider the application for a Premises Licence at 6 Mealhouse Brow, Stockport.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) detailing an application from Mr Martin Healy for a new premises licence to be granted under the Licensing Act 2003 at 6 Mealhouse Brow, Stockport to permit:-

 

·         the supply of alcohol on and off the premises from Sunday to Thursday between 09.00 hours and midnight and Friday and Saturday between 09.00 hours and 01.00 hours, the following day;

·         the provision of live music (indoors) Monday to Sunday between 09.00 hours and 23.00 hours;

·         the provision of recorded music (indoors) Sunday to Thursday between 09.00 hours and midnight and Friday and Saturday between 09.00 hours and 01.00 hours, the following day;

·         the exhibition of films (indoors) Sunday to Wednesday 09.00 hours to 23.00 hours and Thursday to Saturday between 09.00 hours and midnight;

·         the provision of late night refreshment (indoors) Sunday to Thursday between 09.00 hours and midnight and Friday and Saturday between 09.00 hours and 01.00 hours, the following day; and

·         the staging of sporting events (indoors) Monday to Wednesday between 09.00 hours and 23.00 hours and Thursday to Sunday between 09.00 hours and midnight.

 

The applicant attended the meeting and answered Councillors’ questions in relation to the application.  At this stage in the proceedings, the applicant advised the Sub-Committee that since the submission of the application, the site had subsequently obtained planning permission for its change of use from an A1 to A4 use.  However, following representations from Environmental Health, the approved hours of use had been reduced to being between 11.00 hours and 23.00 hours, Sunday to Thursday, and 11.00 hours to midnight, Friday and Saturday.  The applicant indicated that they would therefore be prepared to amend the application to reduce the scope of the application such that the hours for licensable activity reflected those approved under the planning consent.

 

An objector to the proposal, having previously submitted a written representation in relation to the application, explained their objection and answered Councillors’ questions in relation to the application.

 

There were no representations made by any responsible authority.

 

The Sub-Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Digital, Culture, Media and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)        Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)        Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)       Public Safety

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv)      Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, specifically the representations asserted that the granting of the licence would exacerbate existing levels of disturbance and noise nuisance being experienced in the locality and would result in an increase in litter and detritus.

 

The Sub-Committee noted with approval the content of the applicant’s operating schedule in respect of the prevention of public nuisance licensing objective, specifically that:-

 

·         Doors and windows will be kept closed (except for ingress and egress) to reduce noise nuisance from the premises; and that

·         Prominent, clear and legible notices will be displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.

 

In addition, the Sub-Committee noted that the applicant had offered to amend their application to reduce the hours for all licensable activity to conclude no later than the hours for which planning consent had been granted:-
