5 Application for a Review of the Premises Licence Under Section 53A of the Licensing Act 2003 (Premises Associated with Serious Crime Or Disorder) at Da Shop, 15-19 Worcester Road, Cheadle Hulme, Stockport, SK8 5NW
To consider a report of the Director of Place Management.
The report details an application submitted on behalf of the Chief Officer of Greater Manchester Police for a summary review of the Premises Licence at Da Shop, 15-19 Worcester Road, Cheadle Hulme, Stockport in light of allegations that the premises had been associated with serious crime, serious disorder or both and requesting that the Sub-Committee take interim steps to suspend the premises licence pending a full review.

A representative of the Director for Place Management submitted a report (copies of which had been circulated) detailing an application from Greater Manchester Police for a summary review of the premises licence at Da Shop, 15-19 Worcester Road, Cheadle Hulme, SK8 5NW, and requesting that interim steps be taken by the Sub Committee pending determination of a full review of the premises licence.
In accordance with Section 53(A) of the Licensing Act 2003, the Licensing Authority had been requested by Greater Manchester Police to undertake a summary review of the premises licence at Da Shop, 15-19 Worcester Road, Cheadle Hulme, SK8 5NW, in light of allegations that the premises had been associated with serious crime.
A representative from Greater Manchester Police attended the meeting and answered questions in relation to the application for a summary review.
The Premises Licence Holder, who was also the Designated Premises Supervisor, and their representative, also attended the meeting, and answered questions in relation to the summary review.
The Sub Committee, having heard from the interested parties, proceeded to consider the prevention of crime and disorder and the protection of children from harm licensing objectives in respect of the review, together with the relevant parts of the council’s Licensing Policy and guidance from the Home Office. The decision was then reached on consideration of all arguments given in relation to this specific application.

RESOLVED - That, having heard the application for a summary review of the premises licence at Da Shop, 15-19 Worcester Road, Cheadle Hulme, SK8 5NW, made on behalf of the Chief Officer of Greater Manchester Police, and having considered all of the evidence presented, the Sub Committee was satisfied that both the premises and licence holder had been associated with serious crime.
However, the Sub Committee considered that the timescales in which the alleged incidents took place coupled with the bail conditions that had been imposed on the Premises License Holder did not make it necessary to suspend the premises license on an interim basis, prior to the full review to be held within 28 days.
The Sub-Committee was of the view that, in order to satisfactorily promote the four licensing objectives, in particular for the protection of children from harm and the prevention of crime and disorder, it was not necessary to suspend the premises license or impose further conditions on the license in advance of the full review.
