The Cabinet Member for Finance & Resources (Councillor Jilly Julian) submitted a report (copies of which had been circulated) detailing a proposal for the amendment of the Council Meeting Procedure Rules to provide for the submission and circulation of any proposed amendments to notices of motion in advance of the meeting.

 

RESOLVED – (1) That approval be given the amendment of Council Meeting Procedure Rule 14.6(b) as detailed in paragraph 4.2 of the report.

 

(2) That this rule be disapplied in the case of committee meetings and that an amendment be made to Council Meeting Procedure Rule 26 to include Rule 14.6(b) within the schedule of exemptions.

The Cabinet Member for Finance & Resources (Councillor Malcolm Allan) submitted a report (copies of which had been circulated) requesting that the Council Meeting give consideration to the making of an amendment to the Council Meeting Procedure Rules in relation to the timescale for the submission of amendments to motions on notice.

 

RESOLVED – That the proposed amendments to the Council Meeting Procedure Rules stand adjourned until the 13 July 2023 meeting of the Council in accordance with Council Meeting Procedure Rule 24.2.

The report details the considerations of the Constitution Working Party in relation to the potential for the introduction of a deadline for the submission of amendments to motions on notice at the Council Meeting.

 

The Cabinet is recommended to refer the proposed amendments to the Council Meeting Procedure Rules, as detailed in paragraphs 4.2 and 4.3 of the report, to the Council Meeting, noting that the matter would be required to stand adjourned until the next ordinary meeting of the Council Meeting on 13 July 2023.

It was commented that the current arrangements whereby members are given up to 20 minutes to consider an amendment during a meeting was insufficient and the proposal within the report provided a sensible approach to resolve this issue. 

 

RESOLVED – That the proposed amendments to the Council Meeting Procedure Rules, as detailed in paragraphs 4.2 and 4.3 of the report, be referred to the Council Meeting, noting that the matter would be required to stand adjourned until the next ordinary meeting of the Council Meeting on 13 July 2023.

To consider a report of the Assistant Director – Legal & Democratic Governance.

 

The report details the considerations of the Constitution Working Party in relation to the potential for the introduction of a deadline for the submission of amendments to motions on notice at the Council Meeting.

 

The Scrutiny Committee is recommended to comment on the proposed amendments outlined in paragraphs 4.2 and 4.3 of the report prior to their consideration by the Cabinet and Council Meeting.

The Assistant Director for Legal and Democratic Governance submitted a report (copies of which had already been circulated) detailing the considerations of the Constitution Working Party in relation to the potential for the introduction of a deadline for the submission of amendments to motions on notice at the Council Meeting.

 

It was noted that the matter had been previously considered by the Constitution Working Party at their meeting held on 16 February 2023.

 

RESOLVED – That the report be noted.
