The report details an application from Old Cheadle Bar Limited for a premises licence to be granted under the Licensing Act 2003 at Infused, 5 High Street, Cheadle, Stockport, SK8 1AX.

The Sub Committee is requested to determine the application for a premises licence by Old Cheadle Bar Limited in respect of Infused, 5 High Street, Cheadle, Stockport, SK8 1AX.

A representative of the Director for Place Management submitted a report (copies of which had been circulated) detailing an application for a new premises licence to be granted under the Licensing Act 2003 at 5 High Street, Cheadle, Stockport, SK8 1AX, to permit the sale of alcohol, and live and recorded music (indoors).

 

A representative of the applicant, as well as the applicant, attended the meeting and answered questions in relation to the application.

 

An objector to the proposal, having previously submitted a written representation in relation to the application on behalf of a number of residents, also attended the meeting to give explanation to the objections and answer questions in relation to the application.

 

There were no representations from responsible authorities to be considered.

 

The Sub Committee, having heard the interested parties, proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of Stockport Council’s Licensing Policy. The decision was then reached on consideration of all the arguments given in relation to this specific application.

 

The Sub Committee found the following:

 

(i)    Crime and disorder

 

The Sub Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)  Protection of children

 

The Sub Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)Public safety

 

The Sub Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iv) Public nuisance

 

The Sub Committee was satisfied that relevant representations had been raised in respect of this licensing objective which focussed on the potential increase in noise nuisance associated with patrons being attracted to and leaving the premises late at the night.

 

It was determined that, in order to properly address the prevention of public nuisance licensing objective, it would be necessary to amend the hours of the licensable activity (sale of alcohol (on and off the premises)) and to impose further conditions on the licence as offered by the applicant.

The Sub Committee deemed it appropriate and proportionate for the hours of the sale of alcohol to be from 10:00 hours to 00:00 hours Sunday to Thursday, and from 10:00 hours to 01:30 hours Friday to Saturday. Further, that conditions be imposed on the licence relating to children leaving the premises by 11:30 hours and for SIA registered door staff from 00:00 hours until closing on Friday and Saturday.

 

It was then

 

RESOLVED – (1) That the hours of sale of alcohol (on and off premises) be approved as follows:

 

·         from 10:00 hours to 00:00 hours, Sunday to Thursday; and

 

·         from 10:00 hours to 01:30 hours, Friday to Saturday.

 

(2) That the provision of live music (indoors) be approved as follows:

 

from 0800 hours to 2300 hours, Monday to Sunday.

 

(3) That the provision of recorded music (indoors) be approved as follows:

 

from 0800 hours to 2300 hours, Monday to Sunday.

 

(4) That approval be given to the imposition of a condition for children to have vacated the premises by 11:30 hours.

 

(5) That approval be given to the imposition of a condition for SIA registered door staff from 00:00 hours until closing on Friday and Saturday.
