To approve as a correct record and sign the minutes of the meeting held on 25 April 2017.

Minutes:

The minutes (copies of which had been circulated) of the meeting held on 25 April 2017 were approved as a correct record and signed by the Chair.

2.

Declaration of Interest

Councillors and Officers to declare any interests which they have in any of the items on the agenda for the meeting.

Minutes:

Councillors and Officers were invited to declare any interests which they may have in any of the items on the agenda.

                                                to the Appellant.  Councillor Lloyd left the meeting                                           and took no further part.

Public Question Time

Members of the public are invited to put questions to the Chair and Members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice.  Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are also available via the Council’s website at www.stockport.gov.uk/public questions.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of Agenda Item 5 – ‘Appeal A634’ which contains information ‘not for publication’ by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Item 5 ‘Appeal A634’ to prevent the disclosure of information relating to an individual.  It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore in breach of Data Protection regulations.

Appeal A6334

To consider an appeal against dismissal against an employee of the Corporate and Support Services Directorate.

 

This item is ‘not for publication’ and has been circulated to Members of the Committee only.

Minutes:

The Committee considered an Appeal against dismissal from an employee of the Corporate and Support Services Directorate.  The Appellant attended the meeting, together with their representative and presented their case.

 

The Committee received documentation, heard presentations and questioning from the Appellant and Management.

 

RESOLVED – The Committee considered the dismissal appeal, presentations and the written documentation that was submitted.  Having listened to all that was said and having read the documentation, the Committee decided to uphold Management’s decision to dismiss the employee on the grounds of incapability due to ill health.  The Committee found that Management had applied the legislation and policies appropriately and fairly.

 

The Committee therefore resolved that the appeal be not upheld.
