Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of Agenda Item 4 (Appeal A264) which contains information “not for publication” by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5- ‘Appeal A264’ to prevent disclosure of information relating to an individual.  It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection regulations.

5.

Appeal A264

To consider an appeal against dismissal from an employee of the Services to People Directorate.

This item is ‘not for publication’ and has been circulated to members of the Committee only.

Minutes:

The Committee considered an appeal against dismissal from an employee of the Services to People Directorate.  The Appellant and their representative attended the meeting and presented their case.  The Committee received documentation, heard presentations and questioning from the Appellant and Management.

RESOLVED – The Committee considered the dismissal appeal, presentations and the written documentation that was submitted.  Having listened to all that was said and having read the documentation the Committee decided to uphold management’s decision to dismiss the employee on the grounds of incapability through ill health.

The Committee found that management had applied the legislation and policies appropriately and fairly.

The Committee therefore resolved that the appeal be not upheld.
