To approve as a correct record and sign the Minutes of the meeting held on 25 February 2013.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 25 February 2013 were approved as a correct record and signed by the Chair.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Minutes:

Councillors and officers were invited to declare any interests they had in any of the items on the agenda for the meeting.

 

No declarations of interest were made.

3.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting, at local information and advice centres and via the Council’s website at www.stockport.gov.uk/publicquestions.

Minutes:

4.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of agenda item 5 (Appeal 259) which contains information “not for publication” by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection regulations.

Appeal A259

To consider a dismissal appeal from an employee of Services for People.

Minutes:

The Committee considered an appeal against dismissal from an employee of Services to People Directorate.  The appellant attended the meeting and presented her case.  The Committee received documents, heard presentations and questioning from the appellant and management. 

 

The Committee agreed the following:-

 

  1. The first return to work could have been handled better, but believed that Management addressed the issues before the second return to work.

 

  1. Management had done everything they could to enable the appellant to return to work but despite their best efforts this could not be accomplished.

 

  1. Management came to the appropriate decision to dismiss the appellant on the grounds of incapability due to ill health.

 

RESOLVED – That having read all of the evidence submitted, listened to and questioned all of the testimony of both parties the appeal be dismissed.
