To approve as a correct record and sign the Minutes of the meeting held on 8 February 2013.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 8 February 2013 were approved as a correct record and signed by the Chair.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Minutes:

No declarations of interest were made.

 

3.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice (Questions must be submitted prior to the commencement of the meeting on the cards provided. These are available at the meeting and at local information and advice centres).

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of agenda item 5 which are marked “not for publication” by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Agenda Item 5 to prevent disclosure of information relating to an individual. It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore be in breach of Data Protection regulations.

Appeal A257

To consider a dismissal appeal from an employee of Services for Place.

 

This item is confidential and has been circulated to Councillors only.

Minutes:

The Committee considered an appeal against dismissal from an employee of Services to Place.

 

The appellant had earlier requested an adjournment on two separate occasions. The first hearing was adjourned from 31 January 2013 until 10:00am on 25 February 2013. The second request for adjournment from 10:00am until 14:00pm on 25 February 2013 was also accepted by the Committee.

 

In the event the employee was unwell and unable to attend but submitted an e-mail for the Committee’s consideration. The appellant had earlier declined to submit any other documents in support of the appeal.

 

The Committee received documents and heard and questioned evidence from management.

 

RESOLVED – Having carefully considered management’s evidence and the appellants e-mail the Committee concluded that management had followed the Council’s procedures and had made adjustments to assist the appellant but acknowledged that these had failed to achieve a sustainable return to work, accordingly they upheld management’s decision and dismissed the appeal.
