EXCLUSION OF THE PUBLIC AND THE PUBLIC INTEREST TEST

To consider whether it is in the public interest to exclude the public during consideration of Agenda Item 5 – ‘Appeal A630’ which contains information “not for publication” by virtue of the categories set out in the Local Government Act 1972 (as amended).

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of agenda item 5 ‘Appeal A630’ to prevent the disclosure of information relating to an individual.  It would not, on balance, be in the public interest to disclose this information to the public because disclosure of the personal information would not be fair to the appellant and therefore in breach of Data Protection regulations.

APPEAL A630

To consider an appeal against dismissal against an employee of the Corporate and Support Services Directorate.

This item is ‘not for publication’ and has been circulated to members of the Committee only.

Minutes:

The Committee considered an appeal against dismissal from an employee of the Corporate and Support Services Directorate.  The Appellant attended the meeting and presented their case.  The Committee received documentation, heard presentations and questioning from the Appellant and Management.

RESOLVED – The Committee considered the dismissal appeal, presentations and the written documentation that was submitted.  Having listened to all that was said and having read the documentation, the Committee decided to uphold management’s decision to summarily dismiss the employee on the grounds of gross misconduct.

The Committee found that management had applied the legislation and policies appropriately and fairly.

The Committee therefore resolved that the appeal be not upheld.
