To approve as a correct record and sign the Minutes of the meeting held on 4 December 2014.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 22 January 2014 were approved as a correct record and signed by the Chair.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public to exclude the public during the consideration of Agenda Item 5 (Licensing Act 2003: Application for a new Premises Licence at Kitchenet, 1-2 The Bramhall Centre, Bramhall) as appendices to the reports contain information relating to an individual, the disclosure of which would not be fair and would therefore be in breach of Data Protection principles.

Minutes:

RESOLVED – That notwithstanding the submission of information as part of Agenda Item 5 – ‘Licensing Act 2003: Application for a New Premises Licence at Kitchenet, 1-2 The Bramhall Centre, Bramhall’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that unless it was necessary for this information to be heard openly during the proceedings of the hearing, the public not be excluded from the meeting.

Councillors and officers are invited to declare any interests which they have in any of the items on the agenda for the meeting.

Licensing Act 2003: Application for a new Premises Licence at Kitchenet, 1-2 The Bramhall Centre, Bramhall pdf icon PDF 53 KB

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report details an application from Kardelen Ltd t/a Kitchenet for a new premise licence to be granted to include the supply of alcohol, on the premises, late night refreshments and recorded music, indoors at 1-2 The Bramhall Centre, Ack Lane East, Bramhall.

 

The Sub-Committee is recommended to consider the application for a new premises licence at Kitchenet, 1-2 The Bramhall Centre, Bramhall.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Kardelen Limited, trading as Kitchenet, 1-2 The Bramhall Centre, Ack Lane East, Stockport, for a new premises licence to be granted to include the supply of alcohol, on the premises, late night refreshments and recorded music, indoors.

 

The Sub –Committee was advised that since the original application had been submitted a number of modifications to the Premises Licence Application had been made.  The modifications stated that no less than 70% of the trading area would be set out for dining, the external seating area would be contained within fixed barriers at all times it was in use, whenever regulated entertainment took place all windows and doors would be kept closed except for access and egress and no televised football would be shown at the premises.

 

The applicants and their representative attended the meeting and answered Councillors’ questions in relation to the application. There were no representations made by any responsible authority.  At this point in the proceedings, the applicant’s representative indicated that the applicant would be prepared to amend the application to remove regulated entertainment from the application.

 

A number of objectors attended the meeting and their representative answered Councillors’ questions in relation to the application.

 

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport.  However the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)            Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

 

(ii)          Protection of Children

 

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

 

 

 

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that no relevant representations have been raised in respect of this licensing objective.

 

(iv)         Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that there was potential for nearby residents to suffer from noise nuisance resulting from the premises.  The Sub-Committee noted with approval the contents of the applicant’s operating schedule and the modified conditions proposed by the applicant, but determined that in order to properly address the licensing objective, it would be necessary to impose further conditions on the licence, namely:-

 

(a)  That 100% of the external seating area be set out for dining.

(b)  That in the light of the significant size of the proposed external seating area, this be cleared and vacated of customers from 22:00 hours.

(c)  That the sliding doors be closed at 22:00 hours.

(d)  That no bottles or glass be disposed of outside the premises after 21:00 hours.

 

The Sub-Committee also noted and gave approval to the amendment to the applicant’s operating schedule proposed by the applicant at the meeting, specifically that the proposal for regulated entertainment be removed from the application.

 

 

RESOLVED – (1) That the hours for the supply of alcohol on the premises be approved as follows:-

 

Monday to Sunday 10:00 hours to 00:00 hours

 

(2) That the hours for late night refreshments at the premises be approved as follows:-

 

Monday to Sunday 23:00 to 00:00 hours

 

(3)  That the premises shall operate as a food led establishment.

 

(4)  CCTV shall be provided in the form of a recordable system.  Cameras shall encompass all ingress and egress to and from the premises and all areas where the sale/supply of alcohol occurs.  The CCTV equipment shall be maintained in good working order, numbered sequentially and kept for a period of 31 days and copies made available to responsible authorities on reasonable request.  The recording equipment  ...  view the full minutes text for item 5.
