The Minutes (copies of which had been circulated) of the meeting held on 29 March 2017 were approved as a correct record and signed by the Chair.

To consider whether it is in the public interest to exclude the public during consideration of Agenda Item 5 (Licensing Act 2003: Application for a Review of a Licence) as the report contained information ‘not for publication’ in accordance with Section 14 92) of the Licensing Act 2003 (Hearings) Regulations 2005 and where the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED - That the public be excluded from the meeting during the consideration of agenda item 5 – ‘Application to Review the Premises Licence at The Palace Bar (Late Lounge), Mill Street, Woodley’ to prevent the disclosure of information relating to an individual in accordance with Section 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005.  It would not, on balance, be in the public interest to disclose this information because disclosure of the personal information would not be fair to the applicant and would breach their data protection rights and the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Councillors and officers are invited to declare any interests which they have in any of the items on the agenda for the meeting.

To consider a report of the Corporate Director for Place Management & Regeneration.

The report details an application from Greater Manchester Police to review the premises licence at the Palace Bar (Late Lounge).

The Sub-Committee is recommended to consider the application for a review of the Premises Licence (Late Lounge), Mill Street, Woodley.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) detailing an application made on behalf of the Chief Officer of Greater Manchester Police, being a responsible authority under the Licensing Act 2003 and in exercise of its statutory function to promote the prevention of crime and disorder and promotion of public safety licensing objectives, for a review of the Premises Licence at the Palace Bar (Late Lounge), Mill Street, Woodley.

A representative of the Chief Officer of Greater Manchester Police and the Premises Licence Holder, attended the meeting and answered Councillors’ questions in relation to the application.

The Sub-Committee noted the additional representation submitted on behalf of Stockport Licensing Authority in support of the application for the review of the premises licence which related to the prevention of crime and disorder licensing objective.

The Sub-Committee, having heard the interested parties, proceeded to consider the protection of children from harm licensing objective in respect of the application, together with the relevant parts of the Council’s Licensing Policy and the guidance from the Department for Culture, Media and Sport.  However, the decision was reached on consideration of all arguments given in relation to this specific application.

RESOLVED - That, having heard the application for a review of the premises licence at the Palace Bar (Late Lounge), Mill Street, Woodley made on behalf of the Chief Officer of Greater Manchester Police, the Sub-Committee was satisfied that the premises had demonstrated its inability to satisfactorily address the prevention of crime and disorder and promotion of public safety licensing objectives by virtue of the ineffective response to the serious incidents of crime and disorder at the premises, namely a failure to retain CCTV images for the required period of time; and a failure to provide CCTV images upon request.

The Sub-Committee further took account of the evidenced failures to comply with further provisions and conditions of the premises licence; namely:-

·         A failure to display the premise licence summary;

·         An inability to supply a copy of the premises licence on demand;

·         The use of glass receptacles in the designated smoking area; and

·         Undertaking licensable activity outside of the approved hours.

The Sub-Committee noted that subsequent to the receipt of this application on 23 March 2017 for the review of the premises licence, on 19 April 2017 the Premises Licence Holder had varied the licence to specify a new Designated Premises Supervisor

However, notwithstanding this variation, the Sub-Committee has determined that in order to satisfactorily address the promotion of public safety and prevention of crime and disorder licensing objectives it will be appropriate and proportionate to impose a further condition stipulating that the former Designated Premise Supervisor (Mr Anthony Pearson) shall not be permitted to enter the premises during the hours approved for licensable activity.
