To approve as a correct record and sign the Minutes of the meeting held on 26 March 2013.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 26 March 2013 were approved as a correct record and signed by the Chair.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during consideration of agenda item 5 (Licensing Act 2003: Application For A Timed Premises Licence To Be Granted At Whitebottom Farm, Compstall) as the appendix to the report contains information ‘not for publication’ by virtue of Category 1 of Schedule 12A ‘Information relating to any individual’ as set out in the Local Government Act 1972 (as amended), the disclosure of which would not be fair and would therefore be in breach of Data Protection principles.

Minutes:

RESOLVED – That notwithstanding the submission of information as part of Agenda Item 5 - ‘Licensing Act 2003: Application for a Premises Licence at Compstall Cricket Club, Ernocroft Road’ which had been classified as ‘Not for Publication’ by virtue of it containing material which related to an individual, the Sub-Committee was satisfied that unless it was necessary for this information to be heard openly during the proceedings of the hearing, the public not be excluded from the meeting.

Councillors and officers are invited to declare any interests which they have in any of the items on the agenda for the meeting.

4.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Sub-Committee on any matters within the powers and duties of the Sub-Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting and at local libraries and information centres).

Licensing Act 2003: Application for a Timed Premises Licence at Whitebottom Farm, Compstall pdf icon PDF 49 KB

To consider a report of the Service Director (Place Management).

 

The report details an application from Karl Hancock of Whitebottom Farm Estates Ltd for a Timed Premises Licence to be granted to include the supply of alcohol, on the premises, the provision of late night refreshments and the provision of regulated entertainment including live and recorded music from Thursday 25 July to Monday 29 July 2013.  

 

The Committee is asked to consider the application for a new Timed Premises Licence at Whitebottom Farm.

A representative of the Service Director (Place Management) submitted a report (copies of which had been circulated) requesting the Sub-Committee to consider an application from Karl Hancock of Whitebottom Farm Estates Ltd for a Timed Premises Licence at Whitebottom Farm, Compstall for the supply of alcohol on the premises, the provision of late night refreshment and the provision of regulated entertainment including live and recorded music from Thursday, 25 July to Monday, 29 July 2013.

 

The Chair advised the Sub-Committee that since the publication of the agenda an additional representation had been received on behalf of the applicant which had only been circulated to objectors immediately prior to the commencement of the meeting.  The Chair advised the Sub-Committee that in the light of this, it would be prudent to consider the adjournment of the proceedings until such a point that the objectors had sufficient time to consider the additional representation.

RESOLVED – That the meeting be adjourned until such a point that those objectors present at the hearing had to their satisfaction had sufficient time to consider the additional representation submitted by the applicant in advance of the hearing.

 

The meeting reconvened at 6.11 pm.

Licensing Act 2003: Application for a Timed Premises Licence at Whitebottom Farm, Compstall (continued)

Minutes:

The Sub-Committee noted that those objectors present, having considered the applicant’s additional representation, had subsequently consented to the continuation of the hearing, and therefore proceeded to consider the application.

 

The applicant advised the Sub-Committee that they wished to submit information additional to that which was received in advance of the hearing for the Sub-Committee’s consideration, namely a letter received from Greater Manchester Fire and Rescue Service.  The representative of the Democratic Services Manager confirmed that the consent of all parties present at the hearing had been given to the consideration of the additional documentary information in accordance with Section 18 of The Licensing Act 2003 (Hearings) Regulations 2005.

 

The applicants attended the meeting and answered Councillors’ questions in relation to the application.  Three objectors also attended the meeting, explained their objections to the proposals and answered Councillors’ questions in relation to the application.  There were no representations made by any responsible authority.

 

The Sub-Committee having heard all interested parties proceeded to consider the licensing objectives in respect of the application, together with the relevant parts of the Council’s licensing policy and the guidance from the Department of Media, Culture and Sport.  However, the decision was reached on consideration of all the arguments given in relation to this specific application.

 

The Sub-Committee found the following:-

 

(i)           Crime and Disorder

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(ii)          Protection of Children

 

The Sub-Committee was satisfied that no relevant representations had been raised in respect of this licensing objective.

 

(iii)         Public Safety

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that concern had been expressed in relation to the ability for emergency vehicles to gain access to the site.  However, the Sub-Committee noted with approval the content of the applicant’s operating schedule with regard to this licensing objective and the additional supporting letter from Greater Manchester Fire and Rescue Service which had been circulated at the meeting and determined that no further conditions were necessary in order to address this objective.

 

(iv)         Public Nuisance

 

The Sub-Committee was satisfied that relevant representations had been raised in respect of this licensing objective, namely that that amplified live music had the potential to disturb local residents and the potential for litter generation.  The Sub-Committee noted with approval the content of the applicant’s operating schedule with regard to this licensing objective, but determined that in order to properly address the licensing objective, it would be necessary to impose further conditions on the licence, namely:-

 

(a) that, in consultation with representatives of Compstall Community Council, appropriate signage be erected throughout the event site advising patrons to leave the event quietly and to respect local neighbours;

 

(b) that, in consultation with representatives of Compstall Community Council, appropriate signage be erected warning local residents and visitors to the Etherow Country Park that the route leading to the event site may be traversed by vehicles more frequently during the lead up to and for the duration of the event.

 

(c) that the applicant liaise with the Council’s Environmental Health Team in relation to the setting of appropriate noise limits generated by amplified live music for the duration of the event.

 

(d) that the updated management plan document be circulated to the relevant responsible authorities in advance of the event taking place.

 

It was then

 

RESOLVED – (1) That the hours for the supply of alcohol on the premises be approved as follows:-

 

18:00 hours to 23:00 hours, on Friday 26 July 2013

12:00 hours to 23:00 hours, on Saturday, 27 July 2013

11:00 hours to 17:00 hours on Sunday, 28 July 2013

 

(2) That the hours for the performance of live music, indoors and outdoors, be approved as follows:-

 

18:00 hours to 00:00 hours, on Friday 26 July 2013

12:00 hours to 00:00 hours, on Saturday, 27 July 2013
