To approve as a correct record and sign the minutes of the meeting held on 14 February 2018.

Minutes:

The Minutes (copies of which had been circulated) of the meeting held on 14 February 2018 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 6-14 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of items 6-14to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicant and would breach their data protection principles.

3.

Agenda Item 14 – ‘Case No. 1661’ as he had previously accepted and declared a gift offered by Metro Taxis/ Roy Pickering in July 2017.

 

Councillor Murphy exercised his discretion and left the meeting during the consideration of this item and took no part in the discussion or vote.

 

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken action to suspend nine hire car drivers’ licences and revoke a further hire car driver’s licence.

 

RESOLVED – That the urgent actions be noted.

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of an existing licensed hire car vehicle driver’s failure to disclose convictions.

 

The Committee is requested to consider whether the applicant is a fit and proper person to continue to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the driver was a fit and proper person to continue hold a hire car vehicle driver’s licence in view of the driver’s failure to notify the Authority of a conviction for an offence.

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That no further action be taken.

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of the proposed licensed hire car vehicle driver’s convictions.

 

The Committee is requested to consider whether the applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the applicant was a fit and proper person to hold a hire car vehicle driver’s licence in view of the applicant’s convictions for a number of offences, and their failure to disclose those convictions as part of their application.

 

The Committee interviewed the applicant in relation to these matters.

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of an incident relating to an existing licensed hire car vehicle driver.

 

The Committee is requested to consider what action, if any to take in regard to the above and possible consideration of a further driving assessment to be undertaken by the driver at their own expense.

Case Number P1661

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of a renewal application received in respect of a hackney carriage driver’s licence.

 

The Committee is requested to consider whether the applicant is a ‘fit and proper person’ to be granted a renewal of a hackney carriage drivers licence and to determine in conjunction, whether the applicant as an existing private hire driver remains a ‘fit and proper person’ to continue to hold a private hire drivers licence.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the driver was a fit and proper person to continue hold their hire car vehicle driver’s licences following the Committee’s previous concerns with regard to the conduct of the driver and a failure on the part of the driver to comply with private hire licensing requirements.

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That the driver be authorised to continue to the hold their hackney carriage and private hire car driver licences.

Case Number P1652

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of a current hackney driver’s failure to disclose convictions.

 

The Committee is requested to consider whether the driver is a fit and proper person to continue to hold a hackney driver’s licence.

RESOLVED – That in the light of the driver’s failure to disclose convictions for a number of offences, the driver’s licence be suspended for a two week period.

The Committee is requested to consider whether the applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the applicant was a fit and proper person to hold a hire car vehicle driver’s licence in view of the applicant’s convictions for a number of offences, and their failure to disclose one of those convictions as part of their application.

 

The Committee interviewed the applicant in relation to these matters.

 

RESOLVED – That the application be refused on the grounds that the offence in question was of a serious sexual nature and was exacerbated by having been perpetrated from within a vehicle and the Committee was therefore of the view that the applicant was not considered to be a fit and proper person to be licensed as a hire car driver.
