The Minutes (copies of which had been circulated) of the meeting held on 22 June 2016 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 7-12 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Items 7-12 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be fair to the applicant and would breach their Data Protection principles.

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken urgent action to suspend five hire car driver’s licences.

 

RESOLVED – to note the urgent decisions.

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report is a response to members regarding the application of a Cumulative Impact Policy in the Borough of Stockport.

 

Members are requested to note the report and consider what action, if any, to take.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which provided Members with a response regarding the application of a Cumulative Impact Policy in the Borough of Stockport.

 

The following comments were made/issues raised:

 

·         Members felt that a Cumulative Impact Policy could be useful where there is an accumulation of licensed premises in a particular area.

·         Members raised questions about who would have to complain in order for the Cumulative Impact Policy to be implemented. 

·         This whole issue is being discussed across Greater Manchester.

 

RESOLVED – (i)      That the Licensing Authority write to the Home Office to request further information regarding Cumulative Impact legislation.

(ii)  That the Chair of the Licensing Committee contact the Chair of the Planning and Highways Committee to request that a similar approach be adopted by that Committee.

The report informs members of the proposed licensed hire vehicle driver's conviction.

 

The Committee is requested to consider whether this applicant is a fit and proper person to hold an executive licence.

The Committee interviewed the applicant in relation to these matters.

 

RESOLVED – That the application be granted.

The report informs members of the proposed licensed assisted hire driver's convictions.

 

The Committee is requested to consider whether this applicant is a fit and proper person to hold an assisted hire licence.

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report informs members of a breach of the condition of a private hire driver's licence relating to the safety of passengers.

 

The Committee is requested to consider what action, if any, to take.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the Committee to consider the suitability of the driver to continue to be licensed as a private hire car driver following a breach of the conditions of the licence relating to the safety of passengers,

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That in the light of the driver’s recent misconduct, a warning letter be placed on his file.

To consider a report of the Corporate Director for Place Management & Regeneration.

 

The report informs members of a failure to adequately maintain a hackney carriage contrary to the conditions for a licensed hackney carriage.

 

The Committee is requested to consider what action, if any, to take.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) requesting the suitability of the driver to continue to be licensed as a hackney carriage driver following a failure to adequately maintain a hackney carriage contrary to the conditions for a licensed hackney carriage.

 

The Committee interviewed the driver in relation to these matters.

 

RESOLVED – That in the light of the driver’s recent misconduct in failing to adequately maintain a hackney carriage, the driver’s licence be suspended for a one week period.
