To approve as a correct record and sign the minutes of the meeting held on 11 October 2017.

Minutes:

The minutes (copies of which had been circulated) of the meeting held on 11 October 2017 were approved as a correct record and signed by the Chair.

2.

Exclusion of the Public and the Public Interest Test

To consider whether it is in the public interest to exclude the public during the consideration of agenda items 7-16 that are marked "not for publication" by virtue of the paragraph 1 of the Local Government Act 1972 (as amended), as they contain ‘information relating to an individual’

 

Minutes:

RESOLVED – That the public be excluded from the meeting during consideration of Items 7-16 to prevent the disclosure of information which was not for publication relating to an individual as defined in Category 1 of Schedule 12A of the Local Government Act 1972 (as amended), the disclosure of which would not be in the public interest, would not be fair to the applicant and would breach their data protection principles.

3.

Declarations of Interest

Councillors and officers to declare any interests which they have in any of the items on the agenda for the meeting.

Councillors and Officers were invited to declare any interests which they may have had in any of the items on the agenda for the meeting.

4.

Urgent Decisions

To report any urgent action taken under the Constitution since the last meeting of the Committee.

Minutes:

A representative of the Corporate Director for Place Management and Regeneration reported that the Corporate Director, in consultation with the Chair, had taken action to suspend 21 hire car drivers’ licences.

 

RESOLVED – That the urgent action be noted.

5.

Public Question Time

Members of the public are invited to put questions to the Chair and members of the Committee on any matters within the powers and duties of the Committee, subject to the exclusions set out in the Code of Practice. (Questions must be submitted prior to the commencement of the meeting on the cards provided.  These are available at the meeting).

6.

Review of Taxi Licensing Conditions of Licence pdf icon PDF 50 KB

To consider a report of the Corporate Director for Place Management and Regeneration.

 

The report informs Members of the intention to carry out a full review of all driver and vehicle licence conditions and policy in conjunction with the conditions.  The process will include a period of consultation with interested parties after which the proposals and consultation results will be presented to the Committee for approval with an intended implementation date of April 2018.

 

The Committee is asked to note the report.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which informed Members of the intention to carry out a full review of all driver and vehicle licence conditions and policy in conjunction with the conditions.  The process would include a period of consultation with interested parties after which the proposals and consultation results would be presented to the Committee for approval with an intended implementation date of April 2018.

 

The following comments were made/issues raised:

 

·         Members of the Committee requested that a further report be presented to the next meeting of the Licensing, Environment and Safety Committee, in order that Members could comment more fully on the proposals.

 

RESOLVED – (i) That the report be noted.

(ii) That a further report on this matter be produced for the next meeting of the Licensing, Environment and Safety Committee on 10 January 2018.

The Committee is requested to consider whether this applicant is a fit and proper person to hold a hire car vehicle driver’s licence.

The report informs Members of a licensed hire car vehicle driver’s recent conduct.

 

The Committee is requested to consider whether the driver is a fit and proper person to continue to hold a hire car driver’s licence.

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) which requested the Committee to consider whether the licensed hire vehicle driver was a fit and proper person to hold a hire car vehicle driver’s licence in view of the driver’s recent conduct.

 

The Committee interviewed the driver, in relation to these matters.

 

RESOLVED – That the driver be suspended for a period of three months under Section 61 of the Local Government Miscellaneous Provisions Act 1976 relating to suspending a private hire vehicle for any other reasonable cause, specifically as a result of the driver’s inappropriate behaviour through his use of social media.

 

The Committee were mindful of their prior dealings with this particular individual and that he had been warned by them previously that should this behaviour be repeated, then it would be taken very seriously.
